감정평가 윤리의 정립을 위한 제도 개선방안에 관한 연구

감정평가의 신뢰성과 공신력은 평가의뢰자의 재산권과 경제활동의 보호라는 측면에서 중요한 의미를 가지고 있다는 점에서 평가윤리의 제고는 중요한 과제라 할 수 있다. 본 연구의 목적은 국내 부동산시장의 맥락하에서 감정평가 윤리의 개선방안을 모색하는데 있다. 감정평가 윤리와 관련된 선행연구들은 감정평가업자가 경쟁의 증가와 소수고객에 대한 의존도 등으로 인해 윤리적인 딜레마 상황에 처해 있다고 분석하고 있다. 감정평가업자에게 있어서 감정평가윤리는 이런 딜레마적 상황에서 평가과정에서의 가이드라인을 제시하고 고객에 대한 경쟁력 있는 서비스를 제공하는데 중요한 역할을 수행하게 된다. 국내 감정평가 징계 자료를 통한 분석결과 감정평가 과정에서 가장 많이 윤리적인 문제가 발생하는 단계는 자료의 수집과 분석단계로 나타났다. 또한, 미국의 감정평가실무기준 (USPAP)과 미국감정평가사협회의 윤리규정에 대한 분석결과 미국의 경우 감정평가 윤리의 규정이 보다 자세하고 감정평가사의 어떤 행동이 윤리적이거나 비윤리적인지에 대해 보다 구체적으로 제시하고 있는 것으로 분석되었다. 본 연구는 국내의 경우 감정평가 윤리의 구체성과 평가사가 전형적으로 범할 수 있는 윤리적인 문제를 보다 명시적으로 관련 제도에 포함할 필요가 있음을 제안하였다.

The reliability and credibility of the appraisal evaluation are important in terms of protection of property rights and economic activity of the appraiser, so raising the evaluation ethics is an important task. The purpose of this study is to seek ways to improve appraisal evaluation ethics under the context of domestic real estate market. Previous studies related to appraisal ethics analyze that appraisers are in an ethical dilemma due to increased competition and dependence on a few customers. For appraisers, appraisal ethics plays an important role in presenting guidelines in the appraisal process and providing competitive services to customers in such dilemma situations. Domestic emotional evaluation as a result of analysis through disciplinary data, the stage where the most ethical problem occurred in the emotional evaluation process was the data collection and analysis stage. In addition, the analysis of the US Appraisal Practice Standards (USPAP) and the American Association of Appraisers Ethics Regulations showed that the United States has more specific provisions on appraisal ethics and about what ethos appraisers are ethical or unethical as a result. This study suggests that the specificity of ethical evaluation ethics in Korea should be more explicitly included in the related system.
