대량탈북-급변통일 시 북한 주민의 남한 이주에 대한 법적 대응

Legal Response to Movement of North Korean Residents to South Korea in Time of Mass-Defection from the North and the Following Sudden Unification

북한에 내전이나 무장봉기 등의 급변사태가 발생하고 북한 정권이 치안질서 유지를 비롯해서 위기상황에 잘 대처하지 못할 경우 대량탈 북의 가능성이 존재한다. 이는 급변통일로 연결될 수도 있다. 이 같은 상황에서는 지금과는 전혀 다른 여러 가지 법적 문제들이 발생할 것으로 예상된다. 그들은 대부분 인권, 사회질서와 공공복리, 안정적인 민족통합, 재정적 부담과 관련이 있는 것으로 보인다. 필자는 그 대표적인 과제로서 급변통일 이후에도 적절한 기간까지 비무장지대의 한시적 존속 및 연장, 남북한 주민에 대한 상대측 지역으로의 거주·이전의 자유 제한, 남한 내에서 주거(정착지원 시설) 및 이동의 규제, 대량 탈북 이주민에 대한 적실성 있는 정착지원 시스템 마련 등을 제시하였다. 대량탈북 상황에서 철저한 법적 준비와 즉각적인 대응만이 좋은 통일을 견인할 수 있다고 생각된다.

If contingencies including civil war or armed rebellion broke out in North Korea(DPRK) and its government did not cope with those sudden changes very well, mass defection from the country could arise at all times. The unexpected events might also lead to a speedy unification of the two Koreas in a short period. Under such occurrence, there will be raised diverse legal problems quite different from those of ordinary times. As a whole it seems they are related with human rights, public order or welfare, national integration, financial burden etc. Regarding North Korean mass defection, main legal tasks to be dealt with by South Korea are taken for example in this article. They are as follows; maintenance of the Korean De-militarized Zone(DMZ) to the proper moment after the sudden unification; setting controls on freedom of residence and movement between South and North Korea; limitation of a right to choose one s own residence and freely move into and out of settlement support facilities in South Korea over the extended period; arrangement of a new suitable settlement support system for the large-scale defectors and the like. Perfect legal preparation and prompt execution alone could result in a better unification for the Korean nation.
