개도국의 무역기술장벽 대응을 위한 WTO TBT 위원회 역할 연구

The Role of the WTO TBT Committee to Facilitate Implementation by Developing Countries

본 논문은 UN SDG8의 지속가능한 경제성장과 무역확대 영역에서, 수입국의 표준 및 기술규제에 의한 무역장벽을 개도국이 효과적으로 극복하고 대응할 수 있는 제도적 방안을 연구하였다. 본문은 개도국이 WTO 다자무역체제에서 활용할 수 있는 WTO 무역기술장벽(TBT) 위원회 절차의 중요성을 논의하기 위하여, 위원회가 개도국의 대응을 지원하고 강화하는 관점에서 수행하는 주요 역할과 이와 관련된 법제적 쟁점을 연구하였다. 그리고 위원회의 실질적인 기술지원 체계와 특정무역현안(STC) 절차 사례 분석을 바탕으로 향후 제도적 개선 방향에 대한 시사점을 도출하였다. 연구의 주요 결과에 따르면, 위원회는 TBT 관련 기술지원 분야에서 분명한 통상법적 근거를 두고 기능을 수행하였으며 자발적으로 활동 영역을 확대해 온 것을 알 수 있다. 체계화를 이룬 주요 영역으로 개도국의 투명성 제고, 역량 강화, 개발수요 정보의 공유가 중심을 이루며, 위원회는 플랫폼을 제공하는 역할을 강화하였다. 그러나 무역을 통한 개발지원의 관점에서 개도국이 수입국 TBT에 대응하고 해소하는 제도적 역할, 특히 STC 절차에서의 위원회 역할이 상대적으로 발전하지 못한 것을 알 수 있었다. 그 원인으로 TBT 해소와 분쟁 해결 지원에 관한 위원회 권한이 통상법적으로 모호하다는 점과 전문성 확보의 문제를 주목하였으며, 이와 관련하여 향후 제도개선에 대한 시사점을 도출하였다.

Developing countries confront an increasing magnitude of technical barriers to trade (TBT) in overseas markets. The barriers involving technical measures and standards not only hinder their trade expansion but constrain their continued efforts to achieve sustainable development through securing diversified foreign markets. However, they lack necessary capacity and resources to effectively exercise their rights to resolve or prevent such barriers as well as fall short of utilizing relevant disput resolution mechanisms provided under the GATT/WTO system. This paper examines roles of the WTO TBT Committee in two aspects: one is its role to facilitate technical assistance to developing countries and the other is its provision of dispute-resolution mechanism that can enhance developing countries’ participation. For the purpose, it analyzed the current state of problems shown in developing countries practice in the Committee’s specific trade concerns procedure. In addition, it explored Committee’s actual achievements assisting developing countries in TBT resolution and capacity building. Main findings may suggest the need to improve the STC procedure in a way to provide with developing countries a speedier and more effective multilateral mechanism to address TBT problems.
