방과후학교 근거법 마련을 위한 정책결정과정에서의 정책네트워크 분석

A Policy Network Analysis on the Policy󰠏Making Process of the After󰠏Schools

본 연구는 17대 국회에서부터 20대 국회에 이르기까지 방과후학교 근거법안이 국회에 다수 제출되었음에도 현재까지 가결되지 않은 이유를 분석하고 향후 입법에 대한 제안점을 제시하는데 목적이 있다. 이를 위해 정책네트워크 분석을 활용하여 정책 행위자들의 상호작용 관계와 유형을 분석하였다. 연구결과 2008년 학교자율화 조치 이후 교육부의 정책 결정권한이 상대적으로 축소되고, 다수의 이해관계자는 갈등관계에 있음을 발견할 수 있었다. 이러한 갈등관계는 상임위원회에서 수정‧가결된 법안을 무산시키는 원인이 되기도 하였다. 이후 방과후학교 민간위탁 허용 문제, 강사의 지위 문제 등을 계기로 정책 행위자들의 갈등관계가 지속되고 있음을 발견하였다. 정책 네트워크 분석을 활용한 다수의 연구들은 다원화된 사회에서 정책 행위자들의 상호작용 유형이 갈등관계에 놓여 있을 때 정책은 표류하기 쉬우며, 협력관계로 전환될 때 행위자들의 이해관계가 수렴되고 정책 실현 가능성이 높아짐을 제시하고 있다. 결과적으로 17대 국회에서 20대 국회에 이르기까지 발의된 법안이 가결되지 못하고 답보상태에 머물러 있는 이유는 정부의 정책 결정권한이 약화된 상황에서 정책 행위자들의 갈등관계가 지속되고 있는 것에 기인한 것이라고 볼 수 있다. 이러한 결과를 바탕으로 향후 행위자들 간의 지속적인 논의와 조정과정을 통한 의견수렴과정이 필요함을 제언하였다.

The purpose of this study is to clarify the reasons why the after󰠏school bills have been submitted to the National Assembly since the 17th National Assembly to the 19th National Assembly. To do this, we analyzed the interaction relations and types of policy actors using policy network analysis. As a result, the decision making authority of the Ministry of Education has been reduced relatively and the majority of stakeholders have been in conflict. This conflict has also caused the legislation passed by the Standing Committee to be null and void. Since then, the conflicts of policy actors have continued with the issue of the permission of private custody of after󰠏school and the status of lecturers. Many researches using policy network analysis show that when the interaction types of policy actors are in a conflict relationship in a pluralized society, the policy is easy to drift, and when they are converted into a cooperation relationship, Suggesting that the possibility is increasing. As a result, the legislative initiative from the 17th National Assembly to the 20th National Assembly has failed to pass, and the reason for its stagnation is due to the continuing conflicts among policy actors in a situation where the government s power to make decisions is weakened Was. Based on these results, it is suggested that the process of feedback should be continued through discussions and coordination among actors.
