제주특별자치도 자치분권을 위한 의회와 집행부의 관계

Rethinking the Relation between Executive and Legislative Branches of the Jeju Special Self-Governing Province

지속가능한 발전은 민주주의의 공고화를 토대로 가능하며, 이런 의미에서 제주의 특별자치는 지역 경제발전과 함께 종국적으로 지방분권을 통한 지역 민주주의의 발전을 그 필요충분조건으로 한다고 보아야 한다. 지난 2006년 6월 제주특별자치도 설치 및 국제자유도시 조성을 위한 특별법은 고도의 자치권이 보장되는 제주특별자치도를 설치하여 실질적인 지방분권을 보장하고, 행정규제의 폭넓은 완화 및 국제적 기준의 적용 등을 통하여 국제자유도시를 조성함으로써 국가 발전에 이바지함을 목적으로 제정되었다. 지금까지 ‘국제자유도시 조성’이라는 측 면에서는 양적 성장과 동시에 집행기관인 제주특별자치도와 도지사에게는 이에 따르는 실질적인 권한 확대를 가져다 줬음에도 불구하고, 상대적으로 ‘자치분권 실현’ 차원에서 보면 특별히 제주특별자치도 도민의 대의기관으로서 각종 정책의 ‘최고의결기관’이라고 할 수 있는 의회운영차원의 제도개선은 여전히 미흡한 실정이다. 이는 기관대립형 구조 하에서 도지사의 권한확대와 비례하여 이를 합리적으로 견제할 의회구조가 여전히 제자리를 찾지 못하고 있기 때문인 것으로 분석된다. 따라서 이 논문은 현재 의회와 도 사이의 구조적 문제를 진단하여 균형 잡힌 새로운 ‘제주형의회 모델’을 확립하는 방안들을 모색하고자 한다.

The sustainable development is difficult without the processes of the democratic consolidation. In contrast with the traditional special autonomy, a model of Jeju Island seeks not only locally economic development by itself, but also ultimately local democracy development through the subsequent nation-wide decentralization reforms including the Constitution revision. With the historic launching ceremony of Jeju special self-governing province in June 2006, a Special Act on Jeju Special Self-Governing Province and International Free City Development generally has been focused to reduce the bureaucratic inefficiency for friendly business environments. Although Jeju Island has been significant economic development, there exist many political challenges to the sustainable development. This is mainly due to the lack of horizontal accountability of the local government. In other words, the excessive executive power of local government has a tendency to make policy through top-down approach. The executive dominance has been resulted from the subordinate legislature under the executive, such as the organizational structure of the local assembly consisting of a large number of personnel from the executive branch. Thus, the purpose of this article is to examine those issues which have been raised in the subordination of the Jeju Provincial Council and which cast light on the balance of the separation of power through the operation of the devolution arrangements.
