테러방지와 공인탐정 제도에 관한 법·제도적 논의

A Legal·Institutional Discussion on Anti-Terrorism and Licensed Private Investigator System

본 연구에서는 테러방지와 공인탐정제도에 관한 법·제도적 논의라는 주제로 양자에 대한 전반적인 검토를 시작으로 공인탐정제도의 정립을 위한 근거법의 마련을 위해 현재 국회에 계류 중인 두 개의 법안에 대한 비교고찰, 효율적인 테러방지를 위한 공인탐정 내지는 민간조사(경비)제도의 과제에 대해 체계적으로 살펴보았다. 구체적으로 제2장에서는 테러리즘과 공인탐정의 개념 및 특징에 대해 살펴보고, 공인탐정제도의 양면성, 즉 본 제도의 공공성과 영리성 측면에서 어떠한 의미를 갖는지 정리했다. 제 3장에서는 공인탐정제도의 근거법으로서 입법의 필요성 및 찬성과 반대 입장에 대해 정리했고, 제20대 국회에 계류 중인 윤재옥 법안과 이완영 법안의 주요사항에 대해 비교·검토했는데, 공인탐정업의 등록 및 지도·감독 규정, 공인탐정의 업무영역 규정, 공인탐정의 결격사유 규정, 공인탐정의 자격시험 및 운영·관리 규정을 중심으로 각 규정의 의미와 향후 추가적 으로 포함되어 논의할 사항을 해외입법례를 통해 비교법적 고찰을 시도했다. 끝으로 본 연구의 가장 핵심적인 사항으로서 효율적인 테러방지를 도모하기 위한 공인탐정제도가 나아가야할 방향에 대해서 모색했다. 즉 경찰청 및 법무부 등 정부와 공인탐정의 상호협력 관계유지, 공인탐정의 테러대응 교육시스템 구축, 공인탐정의 업무영역 확대, 공인탐정의 사이버 테러 대응책 마련 등을 제시함으로써 현 국회에서 논의되어야 할 사항을 제시했다.

In this study, we examined the two legislation currently being discussed in the National Assembly for the establishment of the basic law for the establishment of the licensed private investigator system, beginning with the examination of the meaning of the anti - terrorism and the licensed private investigator system. Specifically, Chapter 2 examines the concepts and features of terrorism and licensed private investigator, and summarizes what the two sides of the licensed private investigator system mean. In Chapter 3, we reviewed the major items of the legislation proposed in the current National Assembly. We reviewed the registration and guidance regulations of the licensed private investigator business, the regulation of the work area of t h e licensed private investigator, the reason for disqualification of the licensed private investigator. In the future, I tried to review the issues to be discussed further with comparative legal examination through overseas legislation. Finally, the most important point of this study is to suggest ways to improve the licensed private investigator system to prevent effective terrorism. That is, the government proposed the improvement of the mutual cooperation relationship between the government and the licensed private investigator, the establishment of the education system for the terrorist response of the licensed private investigator, the expansion of the work area of t h e licensed private investigator, and the preparation of the cyber terror countermeasure by the licensed private investigator.
