중국의 국가안전법제에 관한 고찰

Review on the National Security Legal System in China

중국의 대표적인 국가안전 기관은 중화 인민 공화국 국가안전부(MSS)라고 할 수 있다. 이 국가안전부는 1983년 3월 공안부에서 분리되어 특수 목적의 안보업무(방첩 등)을 담당하는 국무원 산하 정보기관으로 공안부 등과 함께 정법(政法)부처에 소속되어 있으며, 이는 다시 중국 공산당 정치법률위원회(政治法律委員會)를 통해 감독되고 있는데, 이는 중국은 안보기관들의 역할을 보다 강화하는 방향으로 나아가고 있다는 것이다. 왜냐하면 반(反)간첩법의 제정에서 알 수 있는 것처럼 이 법률은 1993년 제정된「국가안전법」의 명칭을 개정하여 제정된 법률로써 2014년 11월 1일 전국 인민대표대회 상무위원회 제11차 회의에서 심의 된 후 가결되어 시행되었는데, 이는 중국 안보기관들의 간첩수사 권한을 대폭 강화하고 외국기관과 개인의 간첩활동에 대한 처벌을 명문화한 것이기 때문이다. 또한 중국의 국가안전법은 제정 후 20년이 경과하였고 국내외의 상황이 크게 변화하는 가운데에서 규정의 재검토와 그 실효성의 향상이 과제로 되고 있다는 미명 아래 2개의 방향에서 개정작업이 진행되었는데, 첫 번째로 간첩 행위의 금지에 관한 규정을 정비・강화하기 위한 반(反)간첩법의 제정과 두 번째로 국가의 안전에 대해 전반적으로 규정하는 새로운 기본법인 중화인민공화국 국가안전법(中華人民共和国国家安全法) 제정이 진행되었다.

The People’s Republic of China s representative national security agency is the Ministry of State Security (MSS). MSS was separated from the Ministry of Public Security in March 1983 and belongs to the Ministry of Public Security along with such as the Ministry of Public Security under the State Council which is responsible for special purpose security affairs. The MSS is being overseen by the Political Legal Committee of the Communist Party in China, which is moving toward strengthening the role of security agency. This law, as enacted by Anti-espionage Law, was amended by the revision of the National Security Act of 1993, which was enacted on November 1, 2014 at the National People s Congress (NPC) After the deliberations at the 11th meeting of the Standing Committee. This is because Chinese security agencies have greatly strengthened the authority of spy investigations and stipulated punishments for foreign organizations and individual espionage activities. In addition, the National Security Act of China has been revised in two directions since its enactment 20 years have elapsed, and the situation has changed dramatically both inside and outside the country. The first is the enactment of Anti-espionage Law for the maintenance and strengthening of the provisions on the prohibition of espionage, and the second is the establishment of a new basic law on the national security in general, the National Security Act of the People s Republic of China Security Law was enacted.
