민주주의 요인이 경찰신뢰도에 미치는 영향에 대한 주요 법체계국가 간 비교연구

A comparative study of the effect of democratization factors on public confidence in the police in four countries representing major legal families

21세기 선진사회에서 ‘경찰에 대한 신뢰’는 사회구성원간의 법과 규칙에 대한 높은 수준의 합의를 이루어 내고 이를 통하여 경찰업무나 경찰활동에 정당성을 부여해 주기 때문에 경찰학 분야에서 오랜 기간 동안 내실 있게 연구되어 왔다. 선행연구에 의하면 ‘민주주의 발전정도’나 ‘민주주의에 대한 인식’ 변인이 경찰신뢰도에 유의미한 영향을 미친다고 보고되었지만 구체적인 측면의 ‘민주주의 지표의 영향력을 제시한 연구를 찾아보기는 어렵다. 본 연구에서는 법체계적으로 각기 다른 네 나라(한국, 중국, 미국, 독일)를 비교하며 인권존중, 공권력의 사생활침해, 인종차별 등의 구체적인 민주화지표가 경찰신뢰도에 어떠한 영향을 미치는지를 검증하였다. 세계가치관조사 자료를 활용한 분석하여 민주화의 구체적인 지표들의 영향력을 중심으로 경찰신뢰도 향상을 위한 정책대안을 제시하였다.

The public confidence in the police is an important aspect of citizen perceptions toward the police in this complex and diversified 21st century society, which is related to the public support of the police and the public obedience of the law enforcement by the police. The research topic on confidence in the police has been investigated often. Some research projects reported the statistical link between the level of democracy and confidence in the police, but the effects of details of the democracy index have not been studied much. This study assesses the effects of perceived respect of human right, perceived intrusion of individual privacy, and perceptions of the racial discrimination on confidence in the police. Additional variables were included based on the instrumental and expressive models of confidence in the police. The context of research is comparative by including South Korea, China, Germany, and USA. These countries represent the hybrid legal system, socialist legal system, civil law system, common law system, respectively. Suggestions for the policy and the future research were discussed based on the findings.
