교사용 법교육 강의안 개발에 관한 연구

Research on Lecture Programs of Law-Related Education for Teachers

오늘날 복잡한 현대사회에서 사회구성원들 사이에 발생하는 다양한 형태의 분쟁을 원만히 해결하기 위해 법의 중요성은 날로 증가하고 있고, 시민들에게 건전한 법의식을 함양하기 위한 법교육의 필요성 또한 강조되고 있다. 특히 학교에서의 법교육은 아직 미성숙한 단계에 있는 청소년들로 하여금 사회의 규범적 가치를 익히고 향후 겪게 될 다양한 법적 문제를 합리적으로 해결할 수 있도록 돕는다는 의미에서 매우 중요하다. 이러한 학교 법교육이 제 기능을 다 하기 위해서는 학생들에게 법을 가르치는 교사들의 역할이 중요하다. 그러나 법은 그 내용이 대단히 복잡하고 양도 방대한 반면, 교육대학이나 사범대학 등 교육과정에서 법에 대한 교육이 충분히 이루어지지 않고 있어 교사들은 교육현장에서 법과 관련된 수업을 할 때 많은 어려움을 겪고 있다. 교사로 임용된 후에도 교사들을 상대로 사법부나 법무부 등 여러 국가기관에 의해 재교육이 이루어지고는 있으나, 그 횟수나 프로그램의 구성 등에 있어 한계가 있는 것으로 보인다. 이 연구는 교사들에 대한 법교육의 실태를 살펴보고 이를 기초로 교사들이 실제로 초ㆍ중ㆍ고등학교에서 학생들을 상대로 사용할 수 있는 실용적인 수준별 강의안을 만드는 것을 목적으로 하였다. 아무쪼록 이 연구를 통해 개발된 강의안이 교사의 법교육에 대한 전문성과 교수능력을 향상시키는 데에 도움이 되기를 바란다.

In today’s complex modern society, the importance of law is increasing day by day to solve various forms of disputes among members of society, and the need for law-related- education to cultivate healthy legal consciousness of citizens is also emphasized. In particular, law-related-education at school is very important in the sense that it helps young people who are still in the immature stage learn the normative values of society and solve various legal problems that will be experienced in the future. In order for the law-related- education at school to function, the role of teachers teaching law to students is very important. However, while the law is very complicated and vast, the law is not fully educated in the universities for the future teachers, so teachers are having a lot of difficulties in teaching law in the education field. Even after becoming teachers, they are given retraining program conducted by various national institutions such as the judiciary and the Ministry of Justice, but there seems to be a limit in the number and the composition of programs. This study looked at the actual condition of legal education for teachers and aimed at making practical lecture programs that teachers could actually use for students in elementary, junior and high schools. The lecture samples developed through this study are expected to help teachers improve professionalism and teaching ability of law-related- education.
