장애여성의 경험과 관점으로 다시 제기하는 재생산권리

A Suggestion of Reproductive Rights from the Experiences and Perspectives of Women with Disabilities

본 연구는 한국사회에서 재생산권리가 법, 정책, 의료, 문화적 차원에서 어떻게 인식되고 있는가에 관심을 가지면서, 특히 그동안 재생산권리의 주체로 여겨지지 못했던 장애여성의 경험을 통해 재생산권리의 정치적 의미와 사회적 맥락을 보고자 하였다. 한국사회에서는 그동안 국가 주도의 인구정책이 강하게 추진되어오면서 여성의 몸이 도구화되고, 경제성장과 국가발전을 위한 모자보건정책이 시행됨으로써 손상과 장애를 가진 이들의 생명이 국가로부터 경시되어왔다고 해도 과언이 아니다. 한편, 강화되는 의료화와 유전자 기술의 발달 및 상품화는 ‘질 좋은 인구’에 대한 욕망을 개인화하고 사회적 불평등을 심화시킬 우려가 있다. 이러한 맥락에서 국가로부터, 가족으로부터 재생산권리를 부정당하고 장애로 인한 차별을 경험하는 가운데서도 임신과 출산을 고민하고 실행하는 장애여성들의 경험과 관점은 재생산권리를 둘러싼 복잡한 권력과 맥락을 파악하는 데 중요한 시사점을 준다. 페미니즘과 장애 정치의 교차를 통해서 재생산권리에 개입되는 젠더, 섹슈얼리티, 건강, 장애, 정상성 등을 비판적으로 분석하고, 국가의 이해가 아니라 인권으로서 재생산권리를 다시 제기하기 위한 논의가 본격화되어야 한다.

This article attempts to investigate political significance and social context of reproductive rights of the women with disability who is never perceived as a subject of it, through their experience by concerning about how the reproductive rights has been conventionally informed in terms of law, policy, medical care and culture in Korea. In Korean society, it could be insisted that women bodies are always instrumentalized while population policy is pushed ahead by government, moreover certain bodies with disability and damage are harshly neglected by nation-state enforcing policy of the mother and child health care for the national-economic development. Meanwhile, it should be worried that emphasizing medicalization and commercializing developmental genetic technology privatize a desire of ‘being good quality population’ and worsen inequality in our society. The experiences and perspectives of women with disability who worry but try to carry out their pregnancy and childbirth even though they are often denied their reproductive rights by their family and nation deliver, in this context, to us very significant insight for understanding complicated power-relation and connection surrounding the reproductive rights. This article accelerates to raise a discussion about the reproductive rights, as the human rights, not as the understanding of government, with critical analyzing every factors relevant to it, such as gender, sexuality, health, disability, normality, through the disability politics interwoven with feminism.
