행정심판위원회의 조직법적 쟁점과 과제

Organizational Issues and Tasks of the Administrative Appeals Commission

최근에 정부는 국민권익위원회 기능을 반부패ㆍ청렴 중심으로 재편하여 반부패 개혁을 보다 내실있게 추진하기 위하여 국민권익위원회 명칭을 국가청렴위원회로 변경하며, 국민권익위원회 기능에서 행정심판 기능을 분리하는 것을 내용으로 하는 ｢부패방지 및 국민권익위원회의 설치와 운영에 관한 법률개정안｣과 현행 국민권익위원회 소속으로 설치되어 있는 중앙행정심판위원회를 국무총리 소속으로 변경하고, 법제처장이 위원장을 맡는 등 법제처에서 행정심판 관련 사무를 수행하도록 하기 위한 ｢행정심판법개정안｣을 2018년 1월 31일 국회에 제출하게 되었다. 두 법안에 있어서 행정심판위원회에 대한 조직법적인 내용은 결국 국민권익위원회 소속의 중앙행정심판위원회를 국무총리 소속으로 변경하고, 법제처장이 위원장을 맡게 하는 것이라고 하겠다. 이에 본 발표문은 먼저 중앙행정심판위원회를 포함하는 행정심판제도의 변천과정 등을 살펴보고(Ⅱ), 행정심판위원회의 본질과 특징 등을 검토한 뒤(Ⅲ), 행정심판위원회제도를 개관한 것(Ⅳ)을 바탕으로 하여 행정심판위원회를 조직법적인 관점에서 고찰하여 국민권익위원회에 소속되어 있는 경우의 장단점 등 쟁점과 이를 국무총리 소속으로 하는 개정법률안의 장단점 등의 쟁점을 분석하고(Ⅴ), 행정심판위원회의 조 직법적 과제로서 행정심판위원회가 어떠한 기관에 소속되는 것이 행정심판위원회가 가장 최적의 기능을 하는지에 대한 고찰을 함과 동시에 과제를 서술하는 것(Ⅵ)으로 구성하고 있다.

Recently, the government changed the functions of the Anti-Corruption and Civil Rights Commission from the function of the National Anti-Corruption and Civil Rights Commission to the content of the Korea Independent Commission Against Corruption, which changes the functions of the Anti-Corruption and corruption committee to the National Rights Commission. In both bills, the systematic content of the administrative tribunal is to eventually change the Central Administrative Appeals Commission belonging to the Anti-Corruption and Civil Rights Commission to the Prime Minister and let the head of the Legislation and Judiciary. In response, this presentation examines the change of Central Administrative Appeals system, including the Prime Minister s Central Administrative Appeals(II), the nature and characteristics of the administrative judgment committee (III), and Central Administrative Appeals Commission system (IV).
