스위스의 대EU 관계: 스위스 모델을 통한 시장접근성 검토와 브렉시트에 대한 함의

The Relation of Switzerland with the EU: Market Access to the Single Market under the Swiss Model and implications for Brexit

이 연구는 EU-스위스 간에 체결된 양자협정을 분석함으로써 이른바 ‘스 위스 모델’의 배경과 특징, 거버넌스에 대해 분석하였다. 이를 통해 스위스 모델을 통해 형성된 유럽단일시장에 대한 접근성이 EU 또는 EEA 회원국 지위를 통한 그것과 어떠한 차이가 있는지, 그리고 그 차이의 원인은 무엇인지를 밝히고자 하였다. EEA가 EU 공동체법의 수용을 전제로 한 포괄적 협정인데 반해 EU-스위스 관계는 120여개의 분야별 양자협정으로 이루어진다. 스위스의 시장접근 성이 EU와 EEA 회원국에 비해 다소 낮은 이유는 EU 공동체법의 수용과 유럽단일시장에 대한 접근성 간에 교환관계가 성립하기 때문이다. EU-스위스 관계가 오늘날과 같이 형성된 데에는 스위스만의 독특한 특징과 EU의 대내 외적 상황이 상호작용한 결과이며, 이 과정에서 작용한 경로의존성 또한 큰설명력을 갖는다. EU의 입장에서 스위스 모델은 기존의 관계구축 방식과 상이하며, 행정적 부담이 큰 바, EU는 또 다른 스위스 모델의 재현을 꺼리고 있다. EU-스위스 관계는 영국이 브렉시트 이후 대EU 관계구축에 있어 노르웨이 모델을 거부하면서 주목을 받았다. 브렉시트 이후 EU-영국 관계로 ‘캐나다 모델’이 거론되고 있으나, 영국 정부가 주장하는 새로운 대EU 관계구축은 사실상 스위스 모델과 제일 유사하다. 반면에 이와 같은 영국의 주장을 EU가 얼마나 수용할 것인지에 대해서는 의문이 있을 수밖에 없다.

This study reviews how the relations between Switzerland and the EU has developed with a number of bilateral agreements and analyzes main features and the governance of the so-called ‘Swiss Model’. It also conducts a comparative study on the market access of this model to the Single market compared with the memberships of the EU and the EEA. Switzerland has a less market access to the Single Market than other Member States of the EU and EEA, because it does not fully accept the EU’ acquis. Its comprehensive adoption is a prerequisite to the full market access to the Single Market. The current relation of Switzerland with the EU is a result of the interaction between the unique characteristics of Switzerland and the internal and external situation of the EU, and the path dependence in this process also has great explanatory power. The Swiss model is different from the relationship of other countries with the EU. The EU used to reluctant to reproduce another cases of the Swiss model due to the administrative burdens.It has been argued that the Swiss model offers a blueprint for future EU-UK relations after Brexit, while the British government claims the ‘Canada model’ based on a comprehensive free trade agreement. In reality, the new EU-UK relationship proposed by the British government is virtually similar to what Switzerland have with the EU. The question is how much the EU will accept such a British proposal.
