변리사 중심의 법조전문자격사 LDP 도입설계방안

법률시장개방과 4차산업혁명시대에서는 특허소송등 지식재산권에 대한 분쟁이 증가되고 사회적 관심이 고조되고 있다. 4차산업혁명시대에 지식재산권의 분쟁을 효율적으로 대응하고, 특허소송의 경쟁력제고, 법조전문자격사간의 평등성 보장원칙에 따른 지식재산권 분야의 전문성 제고, 법조전문자격사의 기득권 보장을 위하여 변리사 중심의 법조전문직역사간의 동업제도의 도입이 시급이 요구되고 있다. 또한 4산업혁명시대에 특허분쟁을 실효적으로 해결하고, 신속하고 전문적인 법률서비스를 제공하며, 국내의 지식재산을 적극적으로 보호하는 방안마련이 교수되고 있다. 그런데 현행 변호사법, 변리사법 등에서는 법조전문직역사간, 법조직역사와 비법조 직역사간, 비법조직역사간의 동업을 전면적으로 금지하고 있다. 최근 법조계 중심으로 법조전문직역사의 변호사에의 통합, 변호사 중심의 LDP 또는 MDP 도입 방안만 논의되고 있는 실정이다. 따라서 우리나라의 전문자격사간 LDP 도입 논의를 고찰한 후, 우리나라에서 변리사 중심의 법조전문자격사간에 동업제도 도입에 따른 법적 과제인 변리사법과 변호사법의 동업금지규정의 위헌성과 개정, 지적재산권보호와 변리사의 독자적 소송대리권 부여, 변리사중심의 법조전문자격사간의 동업허용과 변리사의 법적지위, 변리사중심의 법조 전문자격사간 LDP의 허용범위와 경영권제한, 법조전문자격사 동업에 따른 특허법률전 문가양성을 검토하여 변리사중심의 LDP 설계 방안을 모색하여 합리적으로 제시하고자 한다.

However, the current Lawyer Law and the Patent Attorney Law prohibit cooperation between legal profession history, law organization history, unlawful organization history, and unlawful organization history. Recently, only the integration of the history of legal profession into lawyers and the introduction of lawyer-oriented legal discipinary practices or MDP have been discussed. Therefore, after examining the discussion of introduction of legal discipinary practices, among the professional qualifications of Korea, it is concluded that the lawyer of the patent attorneys centered on patent attorneys in Korea, Patent attorney-centered by reviewing patent licensing expertise by granting exclusive patent attorneyship, partnering with patent attorney-centered legal experts, legal status of patent attorneys, licensed scope of patent attorneys specializing in patent attorneys, The legal discipinary Practices design method of the present invention is proposed and reasonably suggested.
