대학생의 형벌철학에 대한 인식 연구

A Study on the Perception of University Students’ Punishment Philosophy

이 연구는 소년범 및 강력범죄에 대한 엄벌주의의 요청, 국민의 상식에 어긋난 양형에 대한 비판여론 등 최근 발생하는 형벌에 관한 국민의 요청이 과연 무엇으로부터 비롯된 것일까 하는 의문에서 시작되었다. 기존의 연구에서 형벌 부과의 정당성 및 양형의 결정은 형벌의 목적이 무엇인가에 대한 인식, 즉 형벌철학에서 비롯된다는 논거를 토대로 이 연구에서는 우리사회에서 형벌의 부과 및 양형에 대한 일반인들의 태도에 영향을 미치는 형벌철학에 대한 인식을 밝히고자 하였다. 이를 위해 이 연구에서는 첫째, 대학생들을 대상으로 응보 및 예방이론과 관련된 5가지 형벌철학에 대한 선호도를 알아보고 둘째, 성별이 각각의 형벌철학에 대한 인식에 미치는 영향을 분석하였다. 분석결과 이 연구에서는 형벌의 목적이 범죄자가 피해자에게 고통을 준만큼 자신의 범죄행위에 상응하는 처벌을 내려야 한다는 응보철학이 가장 선호되는 것으로 밝혀졌다. 반면, 형벌의 목적이 범죄자를 변화시켜 정상적인 삶을 살도록 해야 한다는 사회복귀철학은 가장 지지받지 못하는 철학인 것으로 나타났다. 또한 성별의 효과가 형벌철학에 미치는 영향을 살펴본 결과, 무력화, 응보, 도덕적 분개감과 관련된 형벌 철학은 여성이 남성보다 더욱 지지하며. 반대로 사회복귀철학은 여성보다는 남성이 더욱 이를 지지하는 것으로 나타났다. 분석결과를 토대로 형벌철학의 인식에 대한 사회적 배경과 함의를 제시하였다.

The study began with questions about what the people s request for punishment stemmed from. In previous studies, it has been found that the justification of punishment and the decision of sentencing result from the perception of what the purpose of punishment is(the punishment philosophy). In this study, the public perception of the punishment philosophy that affects the attitude of imprisonment and sentencing was investigated. The purpose of this study was to investigate the preference of the five types of punishment philosophy related to retributivism and utilitarianism for university students and to analyze the effect of gender on the perception of each penal philosophy. As a result of the analysis, it was found that the retribution philosophy was the most favorable punishment philosophy that the purpose of punishment was to retaliate against punishment of crime as much as the victim suffered. On the other hand, the rehabilitation philosophy that the purpose of punishment is to change criminals to live a normal life has turned out to be the most unsupported philosophy. Also, as a result of examining the effects of gender effects on punishment philosophy, it was found that women are more supportive of philosophy related to incapacitation, retribution and moral outrage. On the contrary, the philosophy of rehabilitation shows that men are more supportive than women. Based on the results of the analysis, the social background and implications for the perception of the punishment philosophy were suggested.
