맹자의 인내의내설에서 살펴볼 수 있는 자연법적 특징

The Characteristics of Natural Law in the Theory of Internality of Ren(仁) and Yi(義) by Mencius : Regarding Its Relevance to the Natural Law Theory by St. Thomas Aquinas

이 글에서는 맹자(孟子)의 인내의내설(仁內義內說)에 대하여 살펴보고, 이러한 주장으로부터 발견할 수 있는 함의가 서구의 자연법 이론과 맞닿는 지점이 있음을, 특히 토마스 아퀴나스의 자연법 이론과 비교함으로써 밝히고자 한다. 맹자의 인내의내설은 당대의 이름 있는 사상가였던 고자(告子)와의 논쟁을 통하여 확립된 것으로, 의(義)가 외재한다는 고자의 주장에 대항하여 의가 내재한다고 주장한 것이다. 이러한 맹자의 견해는 의가 마음의 외부에 있는 사실에 대한 수용이 아니라, 수용된 사실을 바탕으로 내리는 도덕적인 판단이라고 주장한다는 점에서, 그리고 이러한 본성이 예(禮)와 같은 현실적인 규범의 근거가 된다는 점에서 자연법 이론과 충분히 연관하여 생각해 볼 수 있는 주제이기도 하다. 또한 자연법 이론 자체에 대한 사상적 의의를 바탕으로 하여, 맹자의 인내의내설에 대한 보다 깊은 이해를 증진할 수 있다는 점에서 시도할 만한 가치가 있다.

In this paper, I will examine the theory of internality of ren(仁, benevolence) and yi(義, righteousness) by Mencius, especially by comparing the natural law theory by St. Thomas Aquinas, and argue that Mencius’ theory is relevant to the natural law theory in the West. The theory was formed by the controversy between Mencius and Gaozi, who insisted that yi is external. His idea can be regarded relevant to the natural law theory that yi is thought to be a moral judgement about external factors, not external factors themselves and to be a foundation of positive norms like li(禮, rituals), as a human nature. Also, this research is worth an attempt for it enhances the understanding of the theory by Mencius, on the basis of the significance of the natural law theory in itself.
