택지개발사업에서 행정의 역할에 대한 연구

The Role of Public Administration in State-Driven Land Development Projects: Acceleration Policy and Administrative Procedure

‘택지개발촉진법’에 근거한 택지개발사업은 공급 중심의 양적인 측면을 강조하는 대표적인 정부 주도 개발 및 주택보급정책으로 알려져 왔다. 이에 따라 기존의 연구는 주로 주택의 신속한 대량 공급의 결과에 대한 평가가 주를 이루어 왔으며, 촉진 과정의 특성이나 절차에 대한 논의는 많이 이루어지지 않았다. 이 연구는 이러한 문제의식을 바탕으로 경제개발시기 공공 부문이 주도적으로 추진했던 ‘택지개발촉진법’에 근거한 개발사업의 특성을 사업현황 자료와 사례를 바탕으로 분석하고, 개발 과정에서 민주적이고 법에 근거한 행정 과정의 중요성을 실증적으로 살펴보는 것을 목적으로 했다. 이를 위하여 1980년부터 1997까지의 ‘택지개발촉진법’에 근거한 사업을 정권별, 면적별, 지역별, 사업주체별, 사업기간별로 특성을 기술하였다. 또한 ‘택지개발촉진법’을 통한 개발사업들 중 가장 시대적 속성을 띄며 다양한 행위자 조직들의 개입이 공개된 수서지구 사례를 통하여 비공식적인 절차의 작동기제를 분석함으로써 현황 자료의 한계를 보완하였다. 이러한 연구 결과는 행정과정의 속도, 행정의 역할, 행정조직의 민주화, 합법적 절차와 공공가치가 공간의 개발과 밀접한 관련이 있음을 시사한다.

The purpose of this study is to reinvestigate the mechanism of urban development during Korea’s rapid economic growth era. Since ‘Acceleration of Land Development Law’ was formulated in 1981, strong government-led development allowed supplying large quantity of housing until 1990s. However, existing research has mainly focused on the evaluation and quality of policy outcome and did not attempt to understand internal mechanism of accelerated development. In order to fill this research gap, this study examines formal process of ‘Acceleration of Land Development Law’ from administrative procedure perspective using project data from 1980 to 1997 and em-pirically described development law by region, area, presidency cycle and project type. Additionally, ‘Suseo-area housing land development’ was chosen as a case study to explain informal side of development mechanism. Combined findings show that speed of administrative process, the role of administration, democratization of administrative organization, legal process and public value are closely related to the development of urban space.
