법령 개정을 통한 재정분권 확대방안

A Study on the Expansion of Fiscal Decentralization through the Legal Amendment

본 연구는 헌법 개정 없이 재정분권을 확대 실현할 수 있는 법률과 시행령 개정안을 제안하였다. 재정분권의 가장 핵심적인 부분은 자주재원을 확보하는 방안으로 지방세법 개정을 통해 지방소비세율 및 지방소득세율 인상과 지방재정법 시행령 개정을 통해 지방세 비과세 감면 축소를 제시하였다. 정부간 재원중립을 위해 지방세가 확충되면 국고보조금 규모 축소가 동반되면서 국고보조사업의 정비가 필요할 것으로 보여 보조금 관리에 관한 법률 개정을 통해 유사성격의 소 규모 보조사업을 통합 운영하는 포괄보조금 제도를 도입하는 방안을 제시하였다. 또한 본 연구는 국고보조사업에 대한 정부간 기능분담체계 개편이 필요하다고 보여 생존권적 기본권 사업과 전 국민을 대상의 중장기 계획 추진사업에 대하여 국가가 전액 보조할 필요가 있다고 제안하였다. 본 연구는 국세가 지방으로 이양되 면 지방교부세가 자동적으로 축소되고 이런 지방교부세 축소를 상쇄하기 위해 지방교부세법 개정을 통해 지방교부세율 인상이 필요하다고 제안하였다. 마지막으로 본 연구는 주요 지방세 세목의 세원이 서울과 수도권으로 집중됨에 따라 지방세법 시행령과 보조금 관리에 관한 법률 시행령 개정을 통해 지방소비세의 지역별 소비지수 가중치 조정, 지역별 국고보조율 변경 등 수평적 재정조정기능을 강화하는 방안도 아울러 제시하였다.

This study proposed a revision of the Act and Enforcement Decree that would allow the expansion and practice of fiscal decentralization without constitutional amendment. The most important part of the fiscal decentralization was to expand revenue, which was proposed through the revision of the Local Tax Act to increase the local consumption tax rate and the local income tax rate and reduction of local tax exemptions through the revision of the Enforcement Decree of the Local Fiscal Act. This study proposed the introduction of a block grant system to integrate similar small-scale national subsidies through the revision of the Act on the Management of grants. The study also suggested that the government should provide full subsidies for basic survival rights projects and for mid- to long-term planning projects for the entire population. The study suggested that if a national tax is transferred to a local area, it should raise the local grants rate through the revision of the Local Grants Act to offset the reduction in local grants. Finally, the study presented strengthening the horizontal fiscal adjustment functions such as adjusting the regional weights of local consumption index by revising the Enforcement Decree of the Local Tax Act and changing the national subsidy rate, through a revision of the Enforcement Decree of the Act on the Management of grants as the tax revenue of major local taxes is concentrated in Seoul and the Gyeonggi Metropolitan Area.
