우리나라의 경우 2005년 문화예술교육지원법의 제정으로 문화예술 향유의 저변이 확대되었고, 2013년 문화기본법 제정을 통해 모든 시민의 문화권이 보장되었으며 2013년 지역문화진흥법 제정을 통해 일반 개인에게 생활문화 기회가 확대되었다. 그러나 이러한 생활문화 활동은 동호회를 비롯한 생활문화단체나 생활문화 관련 시설 뿐 아니라 온라인 공간에서의 저작물 이용을 전제로 하고 있기 때문에 저작권과의 충돌이 필연적으로 발생할 수밖에 없다. 이와 관련하여 본고는 활성화되고 있는 생활문화의 구현과 저작권의 충돌가능성을 검토하고 이에 대한 해결 방안을 살펴보고자 한다. 이를 위하여 제Ⅱ장에서 생활문화에 관한 법적 근거를 논하기 위해서 헌법상 국가와 문화예술의 관계인 문화국가원리와 문화기본권을 살펴본다. 아울러 생활문화가 산발적ㆍ부분적으로 규정되어 있는 현행 문화예술관련 법제들을 검토한다. 제Ⅲ장에서 다양한 저작물의 이용 가능성을 내포하는 생활문화 활동과 저작권의 충돌을 살펴보고 제Ⅳ장에서는 생활문화 진흥을 위한 저작권 관련 법제도 개선방안을 검토한다.
The enactment of the Culture and Arts Education Support Act of 2005 enlarged the base of enjoyments of art and culture, and the Fundamental Act on Culture of 2013 assures the cultural rights of all citizens. More significantly, the Local Culture Promotion Act of 2014 has expanded opportunities for ordinary individuals to enjoy culture-into-life have been enlarged. However activities in the context of culture-into-life usually involve uses of copyrighted materials and include possibilities of copyright infringements. This article addresses the an inevitable conflict of culture-into-life activities embracing portion of other’s copyrighted works and copyright law protecting copyrighted works and offers potential mechanisms for solving this conflict. Part Ⅱ discusses the Principles of Culture-State and cultural rights as a legal basis of culture-into-life and provides a brief overview of legislation that provide protection of culture-into-life. Part Ⅲ discusses issues involving culture-into-life under the current Korean Copyright Act and Part Ⅳ proposes legal alternative to solve potential conflict.
