멀티유저시스템에서 실행되는 소프트웨어의 저작권 침해 판단

Judgment of Copyright Infringement of Software Running on Multiuser Systems

컴퓨터프로그램 저작권자가 소프트웨어에 판매 이후에도 사용자 통제를 원하는 반면, 사용자 특히 기업ㆍ기관 등은 조직 내 사용자의 프로그램 설치 수량을 최소화하거나 서버 접속 수량을 통제하여 소프트웨어에 투입되는 비용을 낮추고자 한다. 이러한 이유로 멀티유저시스템이 생겨났으나 외형상으로는 한 대의 컴퓨터이지만 여러 명이 동시에 사용할 수 있는 환경을 제공하는 멀티유저시스템은 저작권자의 관점에서 여러 문제를 일으키고 있다. 이는 소프트웨어를 더 적게 구입하고자 하는 사용자와 원하는 수량만큼 판매하고자 하는 저작권자의 이해가 상충한 것이며, 기술의 발달이 새로운 소프트웨어 사용 방식을 제공하여 권리자가 예상치 못한 새로운 침해 행위를 야기한 것으로 볼 수 있다. 본 글에서는 멀티유저시스템에서 소프트웨어를 설치하여 여러 명이 사용하는 것이 저작권자의 배타적 권리를 침해하는 것인지에 관한 판결(대법원 2016. 1. 14. 선고 2015도16928 판결, 원심판결 수원지방법원 안산지원 2015. 2. 11. 선고 2013 고단839 판결)을 비판적으로 분석하였다. 판결에서는 통상적으로 나타나는 설치와 멀티유저시스템에서의 설치에 의한 복제를 달리 판단하였어야 한다. 또한 일시적 복제가 발생하는 메모리의 유형과 사적이용을 위한 복제에 대해서도 오해가 없도록 판시하였어야 한다. 이러한 멀티유저시스템을 통하여 다수의 이용자가 한 대의 컴퓨터에 설치된 동일 프로그램을 업무상 동시에 그리고 독립적으로 사용한 경우에는 설치에 의한 복제 및 사용에 의한 일시적 복제, 또한 전송권의 침해가 발생한다고 보아야 한다.

So in that reason, Multi-user computer system has been created by the user. However, In terms of a copyright holder perspective, a multiuser system that looks like one computer but can be used by multiple users at the same time become a problem. It causes a conflict of interest between the users who want to buy less software and the copyright owners who want to sell the desired quantity. Also, this can be seen as the development of technology provides a new way of use, which could lead to unexpected new violations by the user. This article critically analyzed the Supreme Court verdict on the use of software by multiple users to infringe the copyright holder s exclusive rights. The judgment should have determined that the reproduction by the usual installation and by the installation in a multi-user system would be different. It should also have been judged that there is no misunderstanding about the type of the computer-memory in which the temporary copy and the copying for the private use. If multiple users simultaneously and independently use the same program installed on a single computer through a multi-user system, reproduction by installation, reproduction by temporary use and infringement of transmission rights may occur.
