미국의 형사법 학술지의 현황과 역할

The Current State and Role of Criminal Law/Criminal Procedure Journals & Reviews in the United States

형사법연구 30주년을 맞이한 이 시점에 미국의 형사법 학술지의 현황을 살펴보아 형사법 전문 학술지의 역할을 재정립하고 보다 발전된 학술지의 미래를 제시하는 것은 여러 가지로 큰 의의가 있다. 현재 우리나라의 학술지 현황은 비록 그 숫자가 양 적으로 팽창하기는 하였으나 그로 인하여 학술지의 질적 수준의 담보는 미흡한 상황이다. 미국의 형사법 및 법학 학술지 역시 실무에서의 인용 지수가 전반적으로 하락하고 있고, 특정 학술지에만 투고가 집중되는 등 여러 문제점이 노정되고 있기는 하 다. 하지만 미국 형사법 및 법학 학술지는 법학전문대학원생을 학술지의 발간 과정에 적극적으로 참여시키는 과정에서 연구후속세대의 연구 역량을 확장시키고 실무와의 활발한 공론의 장으로 기능하는 장점이 있다. 이러한 일련의 과정에서 연구후 속세대의 관심을 끌어내고 그들의 적극적인 참여를 독려하는 동시에 학술지의 저변을 더욱 확대하여 국제적인 학술지로서의 위상을 확보하는 것은 미래 형사법 연구가 지향해야 할 점으로 사료된다.

In the United States, usually law journals and law reviews are not published and managed by any law society or law association. Rather the main body of management tends to be a law school while the publisher could be a famous publishing company specialized in law subjects. At the same time, although there are hundreds of criminal law journals and law reviews focusing on specific criminal law/criminal procedure issues, most of them are not being considered as top law journals or law reviews, because the usual fields of law journals range from any public law matters to private law matters. The topics from criminal law matters to criminal procedure ones are not particularly popular subjects that may attract many prominent readers. However there is a certain list categorizing the most influential criminal law/criminal procedure journals and reviews and the main characteristics are not changed when it comes to specialized law journals and reviews. Firstly, law school students participation in terms of editing and blue-booking the articles are essential. Throughout the process of editing hundreds law journal articles, they are able to build up necessary skills and insights to deal with any legal matters. Secondly, peer review by colleagues has become another requirement to make the articles more appealing. From those characteristics we may draw some lessons that we are able to apply to our current status of law journals and law reviews in Korea.
