체육수업시간의 안전사고와 관련한 몇 가지 법적 문제

이 논문의 제목은 “체육수업시간의 안전사고와 관련한 몇 가지 법적 문제”라고 하였다. 도래하지 않은 장래에 어떠한 법적인 문제가 발생할 것인지를 현재의 시점에서 정확하게 예측 내지 예단한다는 것은 사실상 불가능에 가까운 것이다. 그런데 법 제도라는 것은 정의를 실현할 목적으로 사회질서를 합리적으로 규율하고자 만들어진 것이라는 점에서 당해 법 제도의 운용과정에서 불합리한 결과의 발생이 증가되지 않도록 그 위험성을 최소화할 수 있는 실현 가능한 방안들이 지속적으로 모색되는 것이 필요하다. 이와 관련하여 체육수업을 포함하는 학교교육은 학생의 잠재능력을 계발하고 나아가 사회와 국가 의 발전을 도모하며 궁극적으로 인류문화를 형성 및 발전시키는 원동력이라고 보아야 한다. 그런데 학교에서 이루어지는 교육활동 과정에서는 적지 않은 학교안전사고가 발생하고 있으며, 학교안전사고로 인하여 피해를 입은 학생들은 심각한 정신적, 육체적 후유증으로 인하여 다양한 법적 책임의 문제를 발생시키고 있다. 본고에서는 체육수업시간에 발생하고 있는 다양한 학교안전사고와 관련하여 민법 및 국가배상법상 등의 실정법상의 주요한 법리 및 판례 등을 살펴봄으로서 체육수업시간에 가해행위를 한 불법행위자의 책임귀속의 타당성 여부와 학교안전사고의 분쟁을 사회법적 차원에서 해결할 목적으로 제정 된 ‘학교안전사고 예방 및 보상에 관한 법률’의 해석과 관련하여 문제될 수 있는 쟁점 등에 대하여 법리적 및 입법론적 측면에서 검토하였다.

The title of this thesis is ‘Legal Matters in connection with the Safety Accidents in Physical Education Class’ It would be difficult at the present moment to predict exactly what problems may arise in the future. However, there should be efforts to find solutions for problems related to regulation of public order so that the risk of causing unreasonable consequences can be minimized. Education in school develops the potential ability of students, furthermore it seeks the development of a society and a country and is the source of forming and developing human culture. However, accidents in school becomes a serious problem as it causes lots of aftereffect to the victim both physically and mentally. For these reason, the question that who has the responsibility in law necessarily followed these accidents in school. Also teachers may have hard times in pursuing their job as a teacher when the accidents in school are not handled properly. So, in this research, the problem of whose responsibility is looked into closely through the principles and major cases in civil law and State Compensation Act. And prevention of school accidents is examined along with the present way of settling dispute of school accidents, and with the newly established law on prevention and compensation on school accidents.
