유럽 의회 권한 강화의 유럽통합사적 고찰

Political History of the Reinforcement of the Powers of the European Parliament : Contribution of the Rapport of Han Furler (1963)

현재 유럽의회는 각료이사회와 입법권을 공유한다. 하지만 1957년, 유럽경제공동체와 유럽원자력에너지공동체 창설 당시만 해도 불신임제출권과 자문권만 행사할 수 있었다. 1958년부터 유럽의회는 자문권의 개선 및 강화, 그리고 실질적인 입법권 도입을 주장해왔다. 그러나 오랫동안 유럽의회의 권한강화 주장은 유럽공동체뿐 아니라, 학계에도 조명을 받지 못한 것이 사실이다. 유럽의회 의장을 역임한 유럽연합주의자 한스 풀라가 맡았던 1963년도 보고서는 유럽의회 최초의 권한강화와 관련된 본격적인 공식 의견이라 할 수 있다. 풀라 보고서의 주장은 당시 유럽의회의 제한적인 권한에 비하면 상당히 진보적인 것이었다. 그 내용은 자문권 개선 및 강화부터 각료이사회의 유럽의회 의견 채택 거부 시 2차 자문절차 도입, 제3국과의 협력협정 체결 시 실질적인 유럽의회의 동의권 신설, 그리고 1992년 마스트리히트 조약으로 도입된 공동결정권까지, 심도 있는 권한강화에 대한 필요성이 제기되었다. 풀라보고서를 기점으로 집행위원회는 유럽의회 권한강화의 필요성에 대해 인식하고, 일부분 동의를 표하게 되었는데 이는 ‘더 강한 유럽의회’에 대한 집행위원회의 전반적인 동의를 형성하는 데 큰 영향을 미쳤다. 유럽의회 내에서는 추후 유럽의회 의원들의 권한강화 주장에 대한 초석 역할을 하며, 1986년 유럽단일의정서와 1992년 마스트리히트 조약이 유럽의회의 입법권을 대폭 강화시키는 데 중요한 역할을 했다.

The European Parliament (EP) shares a legislative power with the Council of the European Union (EU). But, when it was founded in 1957 by the European Economic Treaty and the European Atomic Energy Treaty, it obtained only a consultation power and a motion of censure. Since then, the EP asserted the amelioration and the reinforcement of the consultation power, and the introduction of the legislative power. But, the claims of the EP were ignored for a long time by the EU institutions, and its importance was overlooked by the scholars. The rapport established by Hans Furler, European federalist and the former president of the EP, was the first official opinion of the Parliament which synthesized the assertions of the reinforcement of its powers : from the amelioration of the consultation power, the introduction of the second consultation procedure when the Council rejects the opinion of the EP, the creation of the assent power regarding of the association agreement between the EU and the third country, to the attribution of the codecision power to the EP. The European Commission agreed on the opinion of the EP, which formed a general position of the Commission toward the Parliament. In the EP, Furler’s rapport played an important role as a basis of the argument of the EP for ‘the stronger Parliament’.
