다문화정책의 역사적 변천 과정과 다문화 법제

Multicultural Policy’s Historical Process of Transition and Multicultural Legislation - Based on Comparison of the PolicyㆍLegal Cases of Korea and the West

본 논문에서는 서구에서의 다문화정책과 법 사례들의 변화 과정과 우리나라 다문화정책의 역사적 변천과정을 비교하여 시사점을 도출하고 현재의 대표적인 다문화 관련법에 대한 내용을 검토하여 그 한계와 개정방향에 대해 언급하고자 하였다. 우리보다 앞서 다문화사회를 경험한 서구의 경우, 다문화 정책에 있어 여러차례 변화를 겪으면서 점차 소수의 문화를 인정하고 함께 공존하는 사회통합 프로그램에 중점을 두는 방향으로 정책을 전개하여 왔다. 최근 들어 다른 특정문화권과의 갈등이 가시화된 경우, 이민정책과 법 적용이 강화되는 성향을 나타내고 있으며 다문화정책의 집행부서도 일원화되는 추세에 있다. 그러나 다른 한편으로는 불법체류자라 할지라도 그 자녀의 학습권과 기본적인 복지는 제한적으로나마 보장하고 있다. 이민자 사회통합정책은 우리나라에 정주하려는 이민자를 건전한 사회구성원으로 육성하는 정책이기에 국가적인 차원에서 종합적으로 설계되고, 전략적으로 추진되어야 한다. 이런 측면에서, 개별 부처중심의 분산형 사회통합정책 추진은 고비용ㆍ저효율이라는 한계를 가질 수밖에 없으며 미래사회를 대비한 적극적인 이민정책을 개발하고 추진하는데 장애가 된다. 이러한 문제를 극복하기 위해서는 추진체계, 지원방식의 재정비와 함께 문화다양성과 사회통합에 대한 국민의 인식도 높여나가야 할 필요가 있음을 본 논문에서 지적하였다.

Our society recently strives to contribute to human rights protection and social integration, by preparing newly enacted law and support policy regarding foreigners residing in Korea and multicultural families as population from various ethnicity and culture has been increased. However, such legal system is still lack of realizing multicultural society. First of all, limitation of legally applicable object of laws which objects are foreigners who are qualified for legitimate stay and multicultural families having one spouse become a Korean nationality by birth, absence of central department of multicultural policy, issues of role allocation between central government and local municipality, necessity of multicultural perspective expansion are still legal improvements in order to become multicultrual society. Looking at the cases of the countries having experienced multicultural society earlier than ours, there were a number of changes in multicultural policy and have become multicultural society like today’s through trial and error. Current trends of such countries’ multicultural policy guarantee children’s rights to study and basic welfare with limits even if they are illegal immigrants, while legislation regarding immigration is enforced. This literature intends to mention limitations and improvements of legislation regarding multiculturalism, by drawing implications through comparing historical process of transition in our multiculturalism policy and by reviewing representative legislation regarding multiculturalism.
