Sentencing factors for violation of unfair competition prevention and trade secret protection

본 연구는 산업보안범죄의 구체적 행태로서 영업비밀침해행위 및 부정경쟁행위 사건에 대한 양형에 영향을 미치는 요인들을 살펴보는 것을 주요 목적으로 하였다. 이를 위하여 2016년까지 산업보안 범죄로 유죄판결을 받은 사건들을 대상으로 판결문을 수집하였고 분석방법은 판결문 내용분석 방식을 선택하였다. 총 257건의 판결문이 수집되었고 이 중 230건의 영업비밀침해행위 및 부정경쟁행위 위반 사건 판결문을 활용 하여 변수들을 추려내었다. 주요 종속변수들은 징역형 선고, 집행유예 선고이고 독립 변수들로는 범죄자들의 인구학적 요인, 법조인 정보, 범죄행위 상황요인, 재판부의 형식을 중점적으로 살폈다. 선고형과 같은 연속변수에 대하여는 다중선형 회귀분석을 활용하였고, 징역형 여부와 집행유예 여부에 대한 분석은 이항변수 분석이 가능한 로지스틱 회귀분석을 통해 살펴보았다. 연구 결과에 따르면 징역형 선고, 선고형량, 그리고 집행유예 선고 여부에 공통적으로 영향을 미치는 요인은 변호사의 유형과 재판부의 유형(합의부 재판부)이었다. 선고 형량을 고려할 경우에만 세부적인 범죄행위 요인들이 고려되고 있음을 확인하였다. 구체적인 연구결과의 내용과 함의들은 본문을 통해 더욱 깊게 논의하기로 한다.

The purpose of this study is to examine the factors affecting the final sentence between prosecutors and judges. To this end, we classified the accused cases and examined the factors influencing the final sentence on the first level court. The data used in the study are the cases sentenced of industrial security crimes until 2016, A total of 230 cases were collected and the used dependent variables are imprisonment, length of sentence, and decision of suspended execution. The independent variables are demographic factors, courtroom player information, legal factors, and the form of the judiciary. These data were analyzed by content analysis and ultimately we examined by multiple linear regression analysis and logistic regression analysis. According to the results of the study, the type of attorney and the type of court (consensus court) were significant to affect on the sentencing decision. The crime related factors were considered on the length of sentencing decision. The detailed research results and policy implication will be covered in the text.
