원전사고와 환경정보공개에 관한 고찰

Nuclear Power Plant Disaster and Legislation on Public Assess to Environmental Information

오늘날 선진국에서는 환경정보를 포함한 국가 보유의 정보의 공개를 법제화하고 는 반면, 우리나라의 경우 정보공개법이 제정되어 정보공개청구권이 인정되고 있으나, 특히 그 자체가 환경보전에 직결되는 의의를 가지는 환경정보의 공개에 대해 서는 환경기술 및 환경산업 지원법 상 환경정보공개제도가 2011년 4월 28일 도입되어 환경정보공개제도 운영규정 을 제정 고시함으로써 환경정보공개제도 정착을 위한 본격적인 준비를 하고 있으나, 동법률에서는 매우 복잡하고 중요한 의미를 담 고 있는 “환경정보”에 대한 개념정의도 흠결되어 있는 등 적지 않은 문제점들을 내포하고 있다. 선진국, 특히 유럽의 경우 환경정보의 중요성을 깨닫게 된 계기가 1986년에 발생한 체르노빌원전사고(Chernobyl disaster)였다. 이를 계기로 입법화가 이루어졌음을 주목할 필요가 있다. 그것은 최근 일본의 후쿠시마원전사고가 발생하였기 때문에 우 리나라의 경우에도 남의 일보듯 할 수 없는 처지이기 때문이다. 정확한 정보제공은 신뢰와 직결된다. 일례로 프랑스는 원자력사고에 대해 ‘모든것을 잘 말하되 잘 설명하여야 한다는 원칙’을 채택하고 있다. 그리하여 원전에 대한 국민들의 신뢰는 상당한 수준에 이르고 있는 것이다. 이러한 맥락에서 보면 정보 공개법과 별도로 선진국들이 환경정보공개법을 제정하였는지를 이해할 수 있다. 이 논문은 우리나라의 현행 정보공개법과 법적 규율면에서의 비교를 위해 외국의 환경정보공개 입법례와 우리나라의 현행 환경정보 관련법령에 대해 조사 분석하였다. 그리고 환경정보공개법의 제정의 필요성을 고찰하였다.

Developed countries, especially Europe, have been aware of the importance of environmental information since the Chernobyl disaster in 1986. It is worth noticing that legislation on environmental information was introduced in response to the disaster because Korea has been in the similar situation after the Fukushima disaster. To provide correct information is an effective way to build trust. For example, France adopts principles be a good speaker and provide full explanation in terms of nuclear accidents. Therefore, citizens trust with regard to nuclear power plants is quite high. In this context, it is understandable the reason legislation on public assess to environmental information was passed separately from the Freedom of Information Act In Korea, the Freedom of Information Act is established. The Freedom of Information Act prescribes that public institutions shall provide information positively as well as their provision of information upon request. However, it is difficult to find out such characteristics in Korean environmental statutes. Paradoxically, this fact indicates that it is necessary to establish new laws relating to environmental information and to adjust existing laws and regulations thereto. This paper researches and analyzes legislation on environmental information in other counties and environmental statutes in Korea in oder to compare with the current Freedom of Information Act in Korea with regard to making regulations
