지방의회 정책보좌인력에 대한 평가와 개선방안

전문적이고 정책적 지방의회를 위한 지방의회 구성원들의 많은 노력, 그리고 관련 법 개정과 제도적 변화에도 불구하고 아직 지방의회에 대한 우려와 부정적 시각은 줄어들지 않고 있다. 지방의회의 전문성 확보에 대한 논의는 지방자치가 재 실시 된 1991년부터 지속적으로 제기되어오고 있지만, 지방의회 사무기구의 인사권 독립 문제와 정책보좌인력에 대한 규범적⋅재정적 문제 그리고 국민의 공감대등 아직 해결을 위해서는 고민해야 할 부분들이 적지 않다. 이는 민주주의의 대한 강한 열망에도 지방의회가 민의를 제대로 대변할 수 있는 전문성을 갖추고 있는지, 갖추어야 할 필요성이 있는지에 대해서 많은 의문을 갖고 있기 때문이라 할수 있다. 지방자치법은 지방자치단체의 의사를 내부적으로 결정하는 최고의결기관으로 지방의회를, 외부에 대하여 지방자치단체의 대표로서 지방자치단체의 의사를 표명하고 그 사무를 통할하는 집행기관으로 단체장을 독립한 기관으로 두고, 의회와 단체장에게 독자적인 권한을 부여하여 상호 견제와 균형을 이루도록 하는 기관대립형을 취하고 있다. 기본적으로 견제와 균형의 원리에 따라 집행기관을 제대로 견제할 수 있도록 지방의회를 보좌하는 사무기구의 인사권 및 지방의회의 정책적 지원을 위한 보좌인력을 갖추고 있어야 하나, 사무기구의 인사권은 지방자치단체장이 갖고 있으며, 정책보좌인력은 법적 근거가 없다는 이유로 구성 자체를 못하고 있는 실정이다. 앞으로 실질적 지방분권과 국가사무의 지방이양 등 지방의정과 행정업무는 증대될 것이며, 지방자치단체의 행정수요가 다양화되고 이들 정책수요를 지방행정 서비스나 정책에 반영할 필요성이 높아지고 있기에, 이러한 분위기를 제도적으로 반영할 수 있는 전문적 행정과 전문지식 및 입법기술에 지방의회도 변화된 분위기에 능동적으로 대처하여야 한다. 그렇기에 지방의회의 자율성과 책임성 그리고 역량을 강화하고 집행기관으로부터의 독립성을 확보하기 위해서는 지방의회의 정책 지원인력 확보 등의 제도적 기반을 바탕으로 전문성을 제고해 나가야 할 것이다.

The local councils should actively cope with the changes in the professional administrative and professional knowledge and legislative skills that can be systematically reflected. Therefore, in order to strengthen the autonomy, accountability and capacity of local councils and to ensure independence from the executive agencies, it is necessary to enhance professionalism based on institutional basis such as securing policy support personnel of local councils.
