공공조달법과 공생발전 -공공조달을 통한 중소기업정책의 발전방안을 중심으로-

Public Procurement and Eco-Systemic Development -Focusing on SME Policy Through Public Procurement-

공공조달은 공생발전과 다양한 방식으로 연계될 수 있는데 본 논문에서는 중소기업정책에 초점을 맞추어서 논의를 전개하였다. 공공조달과 중소기업정책의 연계와 관련하여 미국와 EU의 법제를 살펴보면 다음과 같은 차이점이 나타난다. 미국은 중 소기업제품을 실제로 구매하는 비율을 중시하는 정책을 취하고 있으나, EU는 입낙찰과정에서 자연스럽게 중소기업제품이 경쟁력을 갖는 데에 보다 초점을 맞추고 있다. 우리나라는 중소기업제품 구매촉진 및 판로지원에 관한 법률 을 통해 중소기업 제품을 실제로 구매하는 비율을 중시하는 법제를 채택하고 있어 미국과 좀 더 유사한 모습을 보여주고 있으나, 최근에는 대-중소기업 공동계약 확대, 분리 및 분할발주 활성화로 대규모 IT/SW 사업에 중소기업 참여증대, 납품실적 요건완화 등 입낙찰과정 전반에 중소기업정책을 연계하기 위한 노력도 함께 기울이고 있다. 헌법과 비교법적 검토를 토대로 보면 공공조달과 중소기업정책을 연계함에 있어서는 크게 두 가지의 발전방안을 제시할 수 있다. 첫째, 중소기업의 일방적 보호보다는 중소기업의 경쟁력 강화에 초점을 맞추어야 한다. 둘째, 공공조달의 투명성, 효 율성과 같은 기본원리들과 최대한 조화를 이루는 범위에서 중소기업정책을 실시할필요가 있다. 본 논문에서는 이러한 기본방향을 기반으로 공공조달과 중소기업정책을 연계하기 위한 몇 가지 발전방안을 제시해보았다.

Public Procurement can be linked with eco-systemic development in various ways, and this paper focuses on the relationship between public procurement and SME policy. When United States of America (US) and European Union (EU)’s legal regime are viewed from the standpoint of this relationship, one important difference can be found. While US emphasizes the actual contracting result of SMEs (Small and Medium Sized Enterprises), EU focuses more on enhancing SME’s competitiveness in each stage of public procurement from tendering to award. Korea’s regime is more close to US’s, because Korea also emphasizes actual performance of procurement from SME based on the “Act on the Promotion of Purchase from SME Products.” However, various regimes to strengthen SME’s competitiveness in each stage of public procurement are also actively implemented in Korea recently. Joint procurement, division of lots, lowering the level of past performance are among a few examples. Based on Constitutional Law of Korea, and comparative law analysis, two basic directions can be found for linking public procurement and SME policy. First, strengthening SME competitiveness rather than protecting SME should be put more weight. Second, SME policy should be balanced with the public procurement’s transparency and efficiency. This paper aims to suggest some future tasks for connecting public procurement and SME policy.
