A Study on the Enforcement of ICSID Arbitral Awards in the United States

이 논문의 연구목적은 미국 내 ICSID 중재판정의 집행을 고찰하는 것이다. 한국은 1984년 미국의 총기 회사인 콜트(Colt)로부터 제소되어 ICSID 중재의 피신청 당사국이 된 바가 있으며, 이후 미국계 사모펀드 론스타(Lone Star)와 아랍에미리트 국영석유투자회사(IPIC)의 네덜란드 자회사인 하노칼(Hanocal)이 한국 정부를 상대로 ICSID 중재를 신청하였다. 이들 가운데 콜트 사건은 당사자 사이의 합의에 따라, 하노칼 사건은 신청인의 중재신청 취하로 마무리 되었으나, 론스타 사건은 심리 종결 후 아직 중재판정이 내려지지 않고 있다. 2018년 10월, 론스타 사건의 중재판정부는 한국 정부와 론스타 측에 그해 11월 16일 절차종 결선언을 하겠다고 통보하였으며, 절차종결선언이 이뤄지면 이후 120일, 최장 180일 내 판정을 내려야 한다. 이 때문에 당시만 해도 올해 3월 전에 결론이 날 것으로 예상됐지만, ICSID 중재 판정부는 지난해 11월, 예정일에 절차종결선언을 하지 않았다. 이에 따라 동 사건의 중재판정이올 상반기를 넘길 것으로 전망된다. 이러한 이해를 바탕으로 이 논문은 특히 미국 내에서 ICSID 중재판정의 집행에 관한 미국 법원의 입장을 미국 연방 법전(United States Code, 2012)과 판례의 분석을 통해 고찰한다. 이는 향후 한국 정부나 기업이 미국과의 ICSID 중재 당사자가 되는 경우 중재판정 이후의 집행단계 에서 대응할 수 있는 사전 지식을 제공하는 데 의의가 있다고 생각한다.

Purpose : This paper is to examine the Enforcement of ICSID Arbitral Awards in the United States. Research design, data, methodology : The starting point is the analysis of the enforcement of ICSID arbitral awards in the United States indicates that there are a few important questions regarding the nature of the procedures to be applied that remain controversial issued. Article 53 of the ICSID Convention specifically provides for the finality of awards. Then, the procedure for the enforcement of ICSID awards is governed by the law on the execution of judgements in each country. Most of all, each Contracting State shall recognize an award rendered pursuant to ICSID Convention as binding and enforce the pecuniary obligations imposed by that award within its territories as if it were a final judgment of a court in that State. Results : In the United States, the ICSID Convention is statutorily implemented by 22 U.S.C. § 1650a. The pecuniary obligations charged by such an ICSID Award shall be enforced and shall be given the same full faith and credit as if the award were a final judgment of a court of general jurisdiction of one of the several States. Conclusions : This could lead to an analysis of the main trends regarding the enforcement of ICSID awards by the U.S. Courts.
