한국 여성인권운동의 한계와 극복 방안에 대한 소고 － 성매매특별법의 입법과정을 중심으로 －

A Study on the Limitation of Feminist Movements in Korea

현대에 와서 인권개념은 상당히 다양한 분야에서 사용되고 있다. 이런 인권적 주장은 국가 공권력과 대응하여 상당한 가치 혹은 절대적 가치로서 표현된다. 하지만 본 연구에서 언급한 바와 같이 인권적 측면을 넘어서 대부분의 사회체계는 남성중심적인 시각에서 설정되었다. 남녀불평등이라는 비대칭적인 구조적인 사회 틀을 개선하는데 큰 역할을 담당한 주체는 다름 아닌 여성이었다. 이런 여성인권운동은 여성의 형식적인 평등을 넘어서서 할당제 등의 적극적 우대조치와 같은 결과적 평등의 성취를 위해 노력했으며, 현대에 와서는 절차적 평등의 문제까지도 개입하고 있다. 그렇지만 여성인권운동은 항상 긍정적인 역할만을 수행하는가? 이 글은 이에 대한 해답을 고찰하고자 한다. 여성인권운동, 특히 한국의 여성인권 운동은 상당히 급진적인 면을 가지고 있으며, 이러한 문제의 실질적 사례가 된 것이 ‘성매매특별법’의 입법추진과 실효성의 문제이다. 이글은 여성 인권운동의 한계를 논의하기 위해 여성인권의 개념정립과 여성인권운동의 필요성, 국내 여성인권의 현주소를 정확히 인지하는데 초점을 두었다. 뿐만 아니라, 법실증주의 국가인 한국 내에서 권리의 주장은 입법추진과정을 배제할 수 없기 때문에 법구조적인 측면에서 여성인권신장을 위한 대안을 일반론적인 입장에서 논하였다. 여성인권운동은 여성의 인권신장 뿐만 아니라 소수자인권의 신장에도 필수적인 부분이다. 이것은 남성중심의 시각 에서 처음으로 시각의 변화를 가져온 계기를 여성인권운동이 가져왔기 때문이다.

In modern society, it is important to use conception of human rights in diversity fields. those claims of human rights are more important than most of social diversity claims against state’s power. however society and state still have man centered view. these views still apply in many social mechanisms. while these mechanisms are exist as state for man, women want to achieve women’s social position as equal as man’s social situation. It has gradually developed by women especially, throughout woman’s movements, which are born of these women’s claims. so these movements have included three parts. these have to be included in typical equal, resultant equal, procedural equal. Has women’s movement always contributed to women’s situation of society? the purpose of this study is to examine the radical feminists in korea and to research and to suggest future human rights for women in korea through a prohibition law of prostitution. radical feminists in korea have take part in legislation movements but these movements are limited by radical feminists in korea. so our society need to suggest new or modification plan. in a law positivism such korea, claims of rights in society never exclude legal mechanisms and ignore legal views. Nevertheless, women’s movements of social claim are need a lot of minority human rights’s objects. because there are lot’s of minority objects of society and women’s claim for social position’s improvement initially tried to advocating in stats and society. and at the same time those movements has occurred with getting out of man centered vision.
