성전환자 인권에 대한 고찰

A transsexual entertainer s debut in 2001 led many documentaries on them through numerous TV programs and many people have taken interest in the reality faced by them. Seven years have passed and how much more of their rights are being protected? Looking into the current legislative efforts on anti-discrimination laws being discussed in the National Assembly, one cannot help thinking that we are going back to the poor human rights country under military administration in the 1980s. The anti-discrimination laws currently on the table of the National Assembly do not include the item of sexual orientation in defining the subject of protection. This means that the state does not prohibit discrimination but promotes discrimination or recognizes justification of discrimination. This may be a result coming from inaccurate identification of the reality of the violation of human rights of the transsexual. Transsexuals are faced with much discrimination and inhospitality based on prejudices in their human relationships. They may be able to obtain the gender they want through transsexual operations. However, this is only the appearance and their fundamental problems are not solved. Their biological genders appear on their resident registrations and one cannot belong to any group living an incomplete life. Of course, they may have complete gender they want through changes to family register but its complicated process and strict review make the effectiveness very insufficient. Thus, this paper specifically explores what kinds of violation of human rights of transsexuals there are in their social lives and discusses which policies shall be prepared by the state to solve these problems.
