성소수자의 법적 쟁점과 과제

성소수자에 대한 인권 보장은 세계적인 추세다. 그러나 아직 한국 사회에는 성소수자의 존재를 전제로 하거나, 성소수자의 생활 및 사회관계를 규율 하고 있는 법제도가 미미하다. 자신의 존재조차 드러낼 수 없는 환경에 처한 성소수자들은 생활 전반에서 법제도의 사각지대에 머물 수밖에 없다. 차별금 지법 등에 차별금지사유로 ‘성적지향’을 명문화하는 것은 한국 사회에 존재하는 성소수자들의 존재를 드러내 주는 것이며, 그동안 ‘비정상’의 범주에 있던 성소수자들의 존재를 인권의 보편적 관점에서 ‘정상’으로 선언한다는 의미가 있다. 또한, 성소수자의 인권 보장과 함께 동성파트너십을 법적으로 인정하는 것은 거스를 수 없는 세계적인 추세임에도, 한국 사회는 여전히 동성커플의 법적관계를 인정하지 않고 있다. 동성애자의 가족구성권 법제화의 길 역시 현시점에서는 쉽지 않아 보인다. 그러나 앞으로 동성커플의 관계에 대한 법적 문제도 점차 발생할 것이고, 이와 관련한 법적 보호의 필요성도 커질 것이다. 나아가 세계화 시대를 맞이해 벌써부터 동성커플을 인정하는 외국의 법적 제도를 국내에서 어떻게 적용할 것인지에 대한 국제사법적인 논의들도 생기고 있다. 최근 법원에서는 점차 성소수자에 대한 이해를 바탕으로 성소수자가 처한 상황을 개선하려는 모습을 보여주고 있다. 부산지방법원은 성전환자를 강간죄의 개체로 인정하는 판결을 내렸고, 군법원에서는 ‘계간’을 처벌하도록 규정한 군형법 제92조가 헌법에 규정된 죄형법정주의, 과잉금지원칙에 위배되고, 동성애자 군인의 성적자기결정권, 평등권, 사생활의 비밀과 자유를 침해할 소지가 있다는 이유로 헌법재판소에 위헌제청을 한 바 있다. 더디지만 이러한 개별적인 사례들이 하나 둘씩 쌓여 성소수자와 관련한 법제를 개선을 하는데 일조하고, 일상에서의 성소수자에 대한 상황을 개선시키고 인식을 변화시 키길 기대한다.

The communities in the world have guaranteed sexual-minority human rights. but The communities in Korea have ignored a lot of human rights of sexual-minority and don’t have given them a diversity of legal rights. as a result of that circumstance, there are formally n’t people who have preferred individual special genders in Korea. because it is not important for people who have legal authority about plenty of legal rights in circumstance of sexual-minority. Due to a tendency of world communities I do insist that some of sexual-minority has to be guaranteed lot’s of legal rights. however I think that it is hard of the constituents of family that prefer other sexual-minority to legislate amendments of family law for sexual-minority. See the reality in Korea, sexual-minority will go on increasing before long. if that is true, this reality may generate a lot of side effects in the community in Korea. In the last resort, these side problems will make our sociality confusion and not trust. so we have to recognize these problems of sexual-minority, improve a diverse parts for those who have preferred to be sexual-minority. In order to improve legislating for sexual-minority, we will find a verity law of sexual-minority in other states and countries, compare these laws and remedy treatment for sexual-minority. Of course, The courts in the our society have tried improving treatment of sexual-minority in the recently. for instance, there are a verity of rape cases of sexual-minority in the troop. we must actually know that a verity of sexual-minority in Korea has infringed constitution rights such as article 10, 11. for example there are the principle of legality and privacy rights in the troop. I wish to enhance the status of sexual-minority and to change the rights of sexual-minority throughtout piled cases for those who prefer other sexual-minority.
