The Characteristics of Legislation Regulating Electronic Surveillance in the Workplace

이 글은 정보사회의 발전과 더불어 심화되고 있는 사업자 전자감시의 문제를 다룬다. 그러나 입법적인 대안을 제시하기보다는, 이러한 대안 형성의 이면에 존재하는 논의 지형을 심도 있게 고찰해 보고자 했다. 로베르토 웅거(Roberto Unger)의 논의에 기초해 본다면, 법적 규제모델은 크게 “자유주의”, “복지국가”, 그리고 “조합국가” 모델로 구분해 볼 수 있을 것이다. 이중 사업장 전자감시와 관련된 규제영역은 기본적으로 조합국가적 법적 규제모델, 즉 사업장 내부의 관행과 규칙(취업규칙 등)을 중시여기는 법적 규제가 상당한 비중을 차지하는 영역이다. 또한 정보기술과 관련한 규제 방식에는 “법적 규제”는 물론이고, “구조 규제”에 대하 고려도 추가되어야 한다. 구조 규제는 사회적 자원 및 장치들의 설정을 변경함으로서 인간의 행위를 제약하는 방식을 의미한다. 사업장 전자 감시는 일종의 구조규제로서의 성격을 가진다. 결론적으로 사업장 전자감시 사안은 국가의 개입이 용이하지 않은 조합국가 모델의 영역일분만 아니라, 보이지 않는 규제로서 작용하는 구조규제로서의 성격을 가진다. 따라서 사업장 전자감시 문제를 입법적으로 규율하는 데에는 상당한 한계가 따른다.

This article is about the problems of electronic surveillance in the workplace, which is getting worse along with the development of information society. However, this article examines not the concrete legislative alternatives but the legislative landscape behind those alternatives. On the basis of Roberto Unger’s theory, legal regulation models can be divided into three categories, the model of “liberalism”, “welfare state” and “corporate state.” Among these categories, electronic surveillance in the workplace can be mostly explained through the corporate state model. The reason is that welfare state model is focused on the inner practices and rules of workplace. Relating to the method of regulation, “architectural regulation” as well as “legal regulation” should be considered in the sphere of information technologies. Architectural regulation means the method which regulates human behavior by changing social resources and devices. Electronic surveillance in the workplace has characteristic of an architectural regulation. In conclusion, the problems of electronic surveillance in the workplace can be regarded in the perspectives of “corporate state model” which means the difficulty of state intervention, and “architectural model” which means invisible regulation. Thus, there are much limitations to regulate electronic surveillance in the workplace through state legislation.
