언론에 의한 성폭력 2차 피해와 민사법적 해결방안

최근 미투운동으로 인하여 성폭력 사건에 대한 관심이 높아지고 있다. 관심이 높아짐에 따라 성폭력 범죄에 관한 언론의 보도가 증가하였다. 그러나 이를 보도함에 있어서 피해자의 사생활과 관련한 자료를 보도하거나 피해자를 특정 지을 수 있는 단서를 함께 보도하는 등 피해자의 신원을 노출시키는 문제로 인하여 피해자에게 발생하는 2차 피해 또한 막대하다. 게다가 언론의 보도로 인한 경우 매우 넓은 범위에 매우 빠른 속도로 정보가 전달되어 동시다발적인 2차 피해가 발생하며, 지속적으로 그 피해가 나타난다는 점에서 막대한 피해가 발생한다고 할 것이다. 그럼에도 불구하고 언론 보도에 의한 2차 피해에 관하여 규정하고 있는 경우는 드문 편이며, 그마저도 2차 피해의 발생을 효율적으로 억제하고 있지는 못하다. 또한 몇 가지 있는 규정들은 대부분 이미 2차 피해가 발생한 후에 그 피해의 구제를 위한 수단이며 이러한 수단을 이용해서는 완전한 피해의 전보 또한 어렵다. 이에 언론보도에 의해 발생하는 성폭력범죄의 2차 피해를 최소화 시킬 수 있는 방법과 2차 피해가 발생한 후 효율적인 피해의 구제를 위한 방법을 연구해보고자 한다.

Recently, #me too campaign has raised interest in sexual violence. As interest rose, media coverage of sexual assaults increased. However, the secondary damage to the victim is also enormous due to the issue of exposing the victim s identity, such as reporting information on the victim s private life or together reporting clues that could make the victim specific. Moreover, if media reports are made, the information will be delivered to a very wide range very quickly, resulting in simultaneous secondary damage, and continuous damage. Nevertheless, it is rare to stipulate secondary damage by media reports, and even that does not effectively contain the occurrence of secondary damage. In addition, several provisions are mostly means of relief after the second damage has already occurred, and using these means it is also difficult to telegraph full damage. In response, we will study how to minimize the secondary damage of sexual violence crimes caused by media reports and how to effectively relieve the damage after the second damage occurs.
