광역지방자치단체에서의 민주시민교육의 법제화: 쟁점 분석과 독일 사례 참조를 통한 개선방안 제안

Institutionalization of Civic Education in Korean Wide-area Autonomous Entities: Analysis of Issues and Suggestions for Improvements in Comparison to Cases in Federal States of Germany

민주시민교육을 위한 보편적 법률의 제정이 오랫동안 공방을 거듭해오며 지연 되고 있는 가운데 광역 및 기초자치단체가 연이어 각각 자치법규 제정을 통해 민주 시민교육을 위한 근거를 마련해오고 있다. 이 논문은 자치단체, 특히 시･도 민주시 민교육조례의 제정 과정 및 조례에 대한 분석을 통해 상위 법률이 부재한 자치법규의 불완전성과 제약, 민주시민교육 실행기관의 설치 및 독립성, 민주시민교육의 중립성 등에 관련된 쟁점들을 분석한다. 나아가 독일에서의 연방 정치교육과 주 정치 교육의 법제, 실행기관, 독립성과 초정파성의 유지를 위한 제도적 장치 등을 참조하여 우리나라 민주시민교육의 법제화 및 실행의 개선방안을 제안한다. 구체적으로 민주시민교육이 법률적 근거를 가져야 함을 강변함과 아울러 현행 자치법규는 민주 시민교육 실행(담당)기관의 독립성과 전문성을 강화하고, 민주시민교육의 초정파성 (비정파성이 아니라)을 확보 및 유지하며, 민주시민교육의 거버넌스를 활성화하는 방향으로 수정･보완되어야 함을 제시한다.

The legislation for a democratic civic education has been held in the Korean National Assembly for over 20 years, and enactments of local ordinances for a civic education in the autonomous entities has been increasing in the past years. Analyzing the enactment processes of the ordinances, particularly those in wide-area autonomous entities, and the main contents of the current ordinances, this paper clarifies issues regarding the ineffectiveness of local ordinances in absence of state legislation, the independence of local civic education agencies, and the didactic neutrality. In a comparative research about the ‘politische Bildung’ (civic education) in German federal states, this paper suggests improvements for the Korean civic education in local entities. Korea needs to push for an individual law for civic education in order to provide more effective and comprehensive services. Furthermore, the direction of local ordinances should be revised to further assure the independence of education agencies, to strengthen political neutrality of civic education, and to promote citizen participation.
