An Analysis of Cross-Border Supply Disputes : Focused on On-line Telecommunication Services

In this paper, we explore cases of cross-border telecom service disputes involving the U.S. to outline some of the major consequences of deregulation that Korea may face if it chooses to liberalize cross-border supply. Easing restrictions on cross-border supply may also result in increased more pressures for trade liberalization. Such a decision by Korea, for instance, may give way to demands such as charging common carriers and telecom resellers equal interconnection rates, lifting restrictions on facilities ownership of value-added service providers and performing Reference Paper commitments, which are all destined to create advantageous conditions for foreign suppliers entering its domestic market. Policymakers therefore need to approach the question prudently in consideration of how far-reaching the ramifications of a decision to liberalize cross-border telecom supply can potentially be.
