지적측량적부심사제도 개선에 관한 연구

A Study on Improvement of the Cadastral Surveying Screening System

본 연구는 지적측량으로 인한 국민의 소유권을 보호하기 위한 비교적 간소한 행정적 권익구제 절차인 지적측량적부심사제도에 대한 개선방안을 제시하는데 그 목적이 있다. 이를 위해 2000년부터 2018년까지 중앙지적위원회에 접수된 지적측량적부재심사 청구건에 대한 현황을 분석하였다. 그리고 지적측량적부심사제도 운영실태 분석을 통해 제도의 문제점과 이를 해소하기 위한 개선방안을 도출하였다. 연구결과 지적측량적부심사제도의 개선방안으로 첫째, 지적위원회에 ADR(Alternative Dispute Resolution; 대체적 분쟁해결)제도를 도입하여 지적측량적부심사 기능 이외에 알선, 조정, 중재 기능을 부여함으로써 위원회의 역할을 강화하고 둘째, 지적측량성과를 불신하는 민원성 지적측량적부심사 청구건에 대하여 지적측량적부심사의 공정성을 담보하기 위해 지적위원회 위원의 현장심의제도를 도입하며 셋째, 경계분쟁소송에 계류 중이거나 확정판결을 받는 등 각하대상임이 명백한 경우 위원회 처리절차를 간소화 한 약식심의제도의 도입을 제안하였다.

The purpose of this study is to suggest the improvement of the cadastral surveying screening system, which is a relatively simple administrative protection of persons right procedure to protect people s ownership due to cadastral surveying. To this end, we analyzed the status of cadastral surveying screening system by the Central Cadastral Committee from 2000 to 2018. And the problem of system and the improvement plan are deducted through the operating condition analysis of cadastral surveying screening system. As a result of the study, we proposed the improvement plan of the cadastral surveying screening system, first, the strength of the role of the committee by giving the function of mediation, coordination, and arbitration in addition to the function of the cadastral surveying screening system with introducing the ADR(Alternative Dispute Resolution) system to the cadastral committee, second, the introduction of the cadastral committee member s the site deliberation system in order to ensure the impartiality of cadastral surveying screening system against the distrust of the result of cadastral surveying, third, the introduction of a simplified deliberation system in case of clear rejection like pending in a boundary dispute lawsuit or final judgment.
