Korea-Japan Talks on Dokdo Dominium – In relation to the perception of the past history

본고는 국교정상화를 위한 한일회담(1951-1964)에서 과거사에 대한 한일 양국의 대립적 인식이 독도 영유권 문제와 어떤 관련을 가지고 있는가를 검토하려는 것이다. 이에 의해 독도 영유권 문제가 순수한 ‘영토’(territory) 문제일 수도 있지만, 실질적으로는 ‘역사인식’(perception of history)에 대한 대립의 연속선상에 위치한다는 점을 지적하고자 한다. 이를 위해 한일회담에서의 두 가지 사례를 분석했다. 첫째, 1952년 일본측 수석대표 구보다 간이치로(久保田寬一郞)의 과거사 발언을 분석했다. 구보다는 카이로선언과 포츠담선언의 법률적 정당성을 부정함으로써 일본의 침략주의를 긍정했다. 둘째, 한일회담 「기본관계조약」을 상세히 검토했다. 이 조약에는 한일강제병합의 성격이 규정되어 있지 않으며, 일본은 현재에도 한일강제병합의 합법성에 대한 주장을 포기하지 않고 있다. 독도 영유권 문제를 역사인식의 관점에서 고찰하려는 이유는 첫째, 영유권 문제가 지닌 다면성을 이해하려는 것이다. 둘째, 일본의 주장을 보다 객관적으로 파악할 뿐만 아니라, 제3자에 대한 한국 입장의 설득력을 강화시키기 위한 것이다. 셋째, 독도 영유권 문제를 인류의 보편적 가치와 연관시킴으로써, 한국의 입장을 강화하기 위한 것이다. 식민지배가 합법적이라는 일본의 과거사 인식은 오늘날 인류의 가치관과는 부합되지 않기 때문이다.

This paper intends to review the relationship of opposite perception on Dokdo Dominium issue and the past history between Japan and Korea at the time of normalization talk.(1951-1964) It points out the issue of Dokdo Dominium not only could be a pure problem of ‘territory’, but also it was recognized as a problem on the continuing confronted line of ‘perception of history’, practically. First of all, this paper analyzed the announcement by Mr. Kubota Kanichiro on the issue of the past history in 1952. He justified the Japanese invasion by opposing the legal justice of Cairo and Potsdam Conference Declaration. Second, this paper examined in detail about the 「Basic Relationship Treaty」 at the talk between Korea and Japan. This treaty did not define the characteristics of compulsive annexation of Korea to Japan. The reason of analysis on Dokdo issue at the historical perspective in this paper is first to understand the multiplicity of the Dominium issue. Second, it aims to find more objective perspectives for Japanese position and to strengthen the persuasiveness of Korean part to the third party. Third, Dokdo issue is related to the universal value of human race which could be favorable for Korea. Because Japanese perception on past history that insisted colonial rule was legal could not coincidence to the value of present age human being.
