친척(親戚)과 친족(親族)의 개념

The Concept of Chincheok(親戚) and Chinjok(親族)

혈연과 혼인으로 맺어진 사람들이나 그들의 관계 또는 그 집단을 일컫는 용어로 친척(親戚)과 친족(親族)이 있다. 이 두 용어는 서로 의미가 다른 용어이지만 한국인들의 일상생활이나 학계에서 잘못 사용되는 경우가 많다. 한국어사전에 의하면 ‘친족’은 ‘촌수가 가까운 일가’ 즉 부계친(paternal relatives)을 지칭하고, ‘친척’ 은 부계친과 외척(maternal relatives) 및 처족(wife’s relatives)을 아울러 일컫는 말이라 규정하고 있다. 이러한 의미 구분은 조선왕조실록(Annals of Joseon Dynasty)에서도 나타나고 있다. 그럼에도 불구하고 한국의 법조계와 사회인류학계에서는 친족을 부계친과 외척 및 처족을 아우르는 의미로 사용하고 있고, 영어의 kinship을 ‘친족’ 이라 번역하고 있다. 이러한 ‘친족’의 의미는 부계친을 지칭하는 한국어 본래의 의미와 상치되는 것이다. 법조계와 사회인류학계에서 ‘친족’을 부계친과 외척 및 처족을 아우르는 의미로 사용하게 된 것은 한국과 달리 혈연성을 강조하지 않는 일본 사회의 법조계와 학계에서 사용하는 용어를 신중한 검토 없이 그대로 수용한 데서 연유한다.

Both ‘chincheok(親戚)’ and ‘chinjok(親族)’ have been used in academia to indicate the people’s relationships or the groups formed by marriage and blood relation. The misuse of the two terms is not rare in Korean everyday life or academic usage while their meanings are actually different from each other. According to Korean dictionary, ‘chinjok’ refers to close family members among paternal relatives only, while ‘chincheok’ is defined as ‘including the paternal, maternal, and wife’s relatives altogether’, which is also found in the Annals of Joseon Dynasty( 鮮王朝實 錄). Nevertheless, it is still prevalent among Korean scholars including jurists and social anthropologists that the ‘chinjok’ is misused to indicate all the paternal, maternal, and wife’s relatives, with ‘kinship’ inaccurately translated into ‘chinjok’. For this case, ‘chincheok’ is thought to be accurate translation for kinship. It is thought that it could be attributed to the historical background that Japanese word ‘しんぞく(親族)’, which has little emphasis on blood relation, was accepted with insufficient review of it.
