대한민국 헌법의 권위주의적 특성에 관한 소고

A Study on the Authoritarian Characteristics of the Constitution of the Republic of Korea

2019년, 현재 한국의 헌법은 자유민주주의 이념에 토대를 두고 있다. 헌법전문을 비롯한 정치권력구조 및 지방자치 등에 관한 규정에서는 더욱 분권화되고 타협적인 자유민주주의의 발전을 위해서는 다소 역기능적인 권위주의적인 면이 발견된다. 한국의 민주화 과정 이후로 보다 지속 가능한 발전을 위한 한국정치시스템을 위해서는 보다 성숙하고 분별력 있는 시민의식이 요구된다. 한국사회의 법과 제도 및 구성원들의 가치관과 행동규범을 규정하고 있는 헌법내용은 권위주의적 정치문화를 유지하는 골격이다.

The present Korean constitution in 2019 is based on liberal democracy. However, the constitutional regulations, political power structure, and realities of local autonomy have some dysfunctional authoritarian aspects impeding and compromising the development of a more decentralized liberal democracy. A Korean political system suitable for more sustainable development requires a more mature and discerning citizen consciousness. The contents of the Constitution, which prescribes the laws and systems of Korean society and the values and the code of conduct of its members, requires changes appropriate for the education of democratic citizens for a better society.
