공공용지취득과정에서의 손실보상에 따른 집단민원의 실태와 제도개선 방안 연구

A Study on the Collective Civil Appeals of Demanding in Compensating of Public Land Acquisition

이 논문의 목적은 공공용지취득과정에서 발생하는 보상요구 집단민원의 행위적이고 제도적인 측면을 연구하는 것이다. 이러한 연구목적을 얻기 위해 개발대상 사업지구에서 이주해야 하는 토지 소유자와 임대인들의 민원사유와 요구사항을 조사하기위해 설문조사가 수행되어졌다. 그 결과자료는 더 많은 보상 수준과 금액을 얻기 위해서 대부분의 토지소유자들이 집단적 민원과 저항을 조직화하고 있다는 사실을 보여준다. 이와 더불어 결과자료는 임대인들 또한 이주비와 이주대책용 임대아파트 입주권 같은 더 나은 보상을 얻기 위해 보다 극단적인 저항방법을 선호한다는 사실을 보여주었다.

The purpose of this article is to investigate behavioral and institutional aspects of collective civil appeals demanding compensation in residential land development processes. To this end a questionnaire survey was conducted to examine the reasons and demand items of land owners and renters who have to move out from designated areas as a residential land development. The results show that most land owners in the areas were used to mobilize collective appeals and protests in order to take higher levels and more amounts of land compensation. The results also indicate that the renters also prefer radical protests to take further beneficial compensations such as moving costs and a move-in right of an apartment from the land developers.
