부동산 관련 법률들은 공공복리, 국토의 효율적 이용, 지역사회의 건전한 발전 및 환경보전등 저마다 공익적 목적의 추구를 위하여 개인의 기본권을 제한하는 근거규정을 가지고 있으나, 이러한 부동산관련 법률 및 부동산관련 제도들은 실제에 있어서 국민의 재산권보장이라는 개인적 권리와 첨예하게 맞물려 있어 권리와 의무간의 충돌을 항상 내재하고 있다. 이렇듯 부동산 은 사적재산으로서의 성격과 공공재산으로서의 성격을 동시에 지니며, 이러한 양면성으로 말미암아 권리와 의무의 충돌은 불가피한 관계에 놓여있다. 따라서 이와 같은 관점에서 부동산활동의 개념에 대해 살펴보고, 부동산활동에 있어 권리와 의무의 역할을 살펴봄으로써 부동산활동에 있어 권리와 의무의 조화에 대한 중요성을 구현함에 본 연구의 목적이 있다.
