유엔안보리제재에 따른 남북교류협력의 법적 쟁점 및 제언 - 개성공단을 중심으로 -

Legal Review of Developing the Inter-Korean Exchanges and Cooperation in UN sanctions against North Korea - Focusing on possibility of resuming Kaesong Industrial Region -

개성공단 사업이 중단된 이후 국제사회의 대북제재 역시WMD 통제에서 경제일반에 대한 광범위한 제재로 바뀌어 가고 있으며, 미국은 법령과 행정명령을 통해 제2차 제재및 제3차 제재(Secondary Boycott)를 강화되는 추세이다. 본고에서는 북한제재 하 현 상황에서 개성공단의 재개가 가능한지 여부, 즉 비상업적 이고 이윤을 창출하지 않는 공공인프라 사업의 경우, 무상인 경우 개성공단의 재개가 가능한지, 유엔안보리제재 제2094호에 따른 벌크캐시(대량현금) 대북유입을 피하면 사업을 재개할 수 있는지 등과 향후 개성공단 재개 시 고려사항이 무엇인지에 대해 살펴 보았다. 또한 유엔안보리 제재 이외 미국, 일본, EU에서 독자적으로 제재를 가하고 있는데, 미국의 독자 제재는 유엔의 제재보다 강력하고 광범위하며, 세컨더리보이콧 규정을 통해 제재국가와 제재 대상 관련 거래를 한 제3국의 개인·기업도 영향을 받는 등 개성공단 재개 여부에 미치는 영향력을 고려하여 미국의 독자제재에 대해 검토하였다.

The UN sanctions against North Korea have dramatically strengthened since 2016. The United Nations Security Council adopted six new resolutions which substantially broadened the scope and areas of prohibited and regulated activities. For example, the Member States decided to prohibit almost all economic transactions with North Korea and required North Korean workers in their countries to return to North Korea. North Korea’s denuclearization issue is being discussed in earnest due to the recently held inter-Korean summit and the North Korea-US summit, and the need to lift North Korea’s sanctions is being raised in this atmosphere. Unless the UN Security Council sanctions and US sanctions are lifted, it is difficult to improve relations with North Korea, including inter-Korean exchanges and cooperation, and it is impossible to build a peace regime on the Korean peninsula. The main contents of the UN Security Council and individual countries’ sanctions against North Korea and the legal nature and effects of sanctions are examined. And We compare the contents of sanctions against North Korea such as the United States analyze the impact of such sanctions on North Korea By Reviewing the limitations and problems of the sanctions against North Korea, we will examine the possibility of lifting North Korea sanctions and
