Polybios’ Constitutional Theory and the Analysis of the Roman Republic

폴리비오스에 따르면 단순정체는 원시군주정으로 시작해서 왕정으로 발전하고, 왕정은 참주정으로 퇴보한다. 참주정을 폐지하고 귀족정이 탄생하고 귀족정은 다시 과두정으로 퇴보한다. 과두정에 대해 인민이 봉기하면 민주정이 형성된다. 민주정은 폭민정의 야만적 상태로 퇴보하고, 다시 군주가 출현해 인민을 지배하는 군주정으로 돌아가 정체의 순환이 완성된다. 단순 정체의 변화와 순환은 필연적인 자연 법칙이며, 모든 단순정체는 불안정하다. 가장 안정된 최선의 정체는 왕정, 귀족정, 민주정의 장점들을 결합한 혼합정체이다. 폴리비오스가 보기에 로마 공화정은 콘술, 원로원, 인민(민회)의 세요소가 서로 견제한 가장 훌륭한 혼합정체였다. 로마 공화정의 세 요소 중 어떤 것도 완전히 독립적이지 못하고 다른 두 요소에 의해 견제되기 때문에 국가의 전체 체계가 안정되었다. 로마 공화정은 마찬가지로 혼합정체인 스파르타의 뤼쿠르고스 정체에 비해 제국을 건설하는 데 더욱 적합하고 역동적이었다. 카르타고도 혼합정체를 가지고 있었는데, 한니발 전쟁이 시작되었을 때 카르타고 정체는 쇠퇴한 반면 로마 공화정은 가장 완전한 형태였다. 카르타고에서는 국사를 논의하는 데 인민이 지배적인 영향력을 가진 반면, 로마에서는 원로원이 인민보다 국정을 주도하고 현명한 결정을 내림으로써 전쟁에서 승리할 수 있었다. 사실 로마 공화정의 민주정적 요소는 상대적으로 약했다. 로마 공화정은 바람직한 모든 특성을 지녔음에도 불구하고 그 정점을 지나면 쇠퇴하지 않을 수 없다. 존재하는 모든 것이 쇠퇴하고 변한다는 것은 자연의 진리이기 때문이다. 로마 공화국의 번영은 사치와 정무관직을 둘러싼 과열 경쟁을 낳고 폭민정으로 변할 것으로 예상되었다. 폴리비오스는 로마 공화정이 내전기를 거쳐 프린키파투스라는 군주정에 이를 것임을 잘 예측한 것 같다.

According to Polybios, simple constitution begins with primitive monarchy(monarchia) and develops into kingship (basileia), and kingship is regressed to tyranny(tyrannis). Abolishing tyranny, aristocracy (aristokratia) is created, and aristocracy is regressed back to oligarchy. When the people rise against oligarchy, democracy(demokratia) is formed. Democracy regresses to a brutal state of mob rule, and when the monarch dominating people appears, the cycle of constitutional change is completed. The changes and cycle of simple constitutions are inevitable natural law, and all simple constitutions are unstable. The most stable and best constitution is a mixed constitution(mikte) of the merits of kingship, aristocracy and democracy. The Roman Republic is the best mixed constitution of three elements, namely consul, senate and people. The whole system of the Roman Republic was stabilized because none of the three elements were completely independent and checked by two other elements. The Roman Republic was also more suited and dynamic to build an empire than Lukurgos’ system of Sparta. When the Hannibal war began, Carthage also had a mixed constitution. While Carthage’s constitution already had begun to decline, Roman Republic was the most complete form. In Carthage people had the dominant influences in determining political affairs, while in Rome Senate controled people and was able to win the war by making wise decisions. In fact, the democratic elements of the Roman Republic were relatively weak. Although the Roman Republic had all the desirable characteristics, it could not help but decline past its peak. It is the truth of nature that everything is decayed and changed. The prosperity of the Roman Republic was expected to produce luxury and overheated competition for public offices. Polybius well predicted that the Roman Republic would go through a civil war and become a monarchy called Principatus.
