이 연구는 교육 분야에서의 개헌 논의를 선도하면서 관련된 주요 연구자들의 의견을 적극적으로 수렴해 나갈 필요성에 터하여 현행 헌법상 교육 관련 조항의 개정 필요성에 대한 공감대의 형성 정도 확인과 함께 개헌 시 구체적으로 반영되어야 할 과제의 도출을 목적으로 하였다. 이를 위하여 교육법 영역을 주된 연구 대상으로 삼는 교육법학 분야의 중견학자들을 중심으로 21명의 페널을 구성한 후 3차례의 델파이 조사를 실시하여 그 결과를 분석하였다. 조사 결과, 첫 번째 조사에서 교육 관련 조항의 개헌 필요성에 합의(내용타당도값(CVR) 0.619)가 이루어졌을 정도로 개헌에 대한 공감대가 형성되어 있음을 확인할 수 있었다. 또한 최종 3차까지의 델파이 조사 결과를 통해 이번 개헌 논의에 있어서 관철이 꼭 필요한 개헌의 과제로 무상의 범위와 내용에 관한 법률유보 문구 추가 등 6가지를 이끌어 낼 수 있었다. 아울러 통계학적인 의미로 합의에 이르지는 못했지만, “의무교육을 국민의 의무가 아닌 국가의 의무로 개정”등 다수의 학자들이 한 목소리를 내는 다양한 개헌의 요구가 있음을 확인할 수 있었다.
This study aims to identify the degree of consensus of the leading scholars and researchers on the need to revise the current constitution provisions on education in the Republic of Korea and to derive issues that should be specifically reflected in the revision. To this purpose, a panel of experts was composed of twenty-one scholars in the field of education law, and a three iterative round Delphi technique was conducted to attain consensus of revision of the constitution on education. The first survey results confirm that there was a consensus on the need to revise the current constitution on education, revealing that the expert agreement was reached to the high value point (0.619). Furthermore, six imperatives were derived from the three-round delphi surveys, including the addition of legal reservations on the scope and content of “free education”. In addition, although this study failed to come to an agreement in a statistical sense, many scholars assert that it is necessary to amend a provision regarding compulsory education to the duty of the State, not to the obligation of the people. Likewise, the survey results support that there were forceful calls for various revisions of the constitution.
