소년법을 통해서 본 학교폭력예방법의 문제점과 개선방안

Problems and Improvements of the School Violence Prevention Law through the Juvenile Act

하루가 다르게 변하고 있는 우리 사회는 그 구성원들간의 분쟁이 자주 발생하고 그것이 심각해져서 사회문제가 되기도 한다. 이러한 문제의 해결을 위해 오늘도 국회는 법을 만들고 있다. 이렇게 많은 법이 제정됨으로 인해 중복되는 법률이나 각 법률 간의 중복되는 조항이 발생되기도 한다. 반대로 비슷한 성격과 목적을 가진 법률이라 하더라도 법률 간의 상호 연계성이 부족한 경우가 발생되기도 한다. 이에 목적이 비슷한 법률을 고찰하여 상호 보완을 하거나 더 좋은 제도의 도입은 법률의 완성도를 높이는데 기여할 것이다. 이 중 교육과 관련된 법은 더욱 완성도를 높여야 한다. 왜냐하면 학교에서의 학생교육이 제대로 이루어지지 않으면 국가는 향후 유지 및 발전에 있어 큰 타격을 입게 될 것이다. 학교에서 가장 큰 문제점은 바로 폭력 때문에 학생들이 학교를 안심하고 다니지 못하고 있다는 것이다. 이는 학교폭력을 해결하기 위해 제정된 학교폭력예방법이제 기능을 못하기 때문이라고 판단된다. 이러한 측면에서 본다면 학교폭력예방법의 부족함을 채울 수 있는 다른 법률과의 통섭은 필요하다고 하겠다. 특히, 학교폭력예방법이 부족해 보이는 것은 학교폭력의 문제가 오랜 기간동안 노력에도 불구하고 최근까지도 큰 사회문제가 되고 있기 때문이다. 학생들의 폭력 수법은 날이 갈수록 더 교묘해 지고 잔인해지고 있다. 이는 학교폭력를 해결하기 위한 길잡이인 학교폭력예방법이 그 해결에 있어 부족함이 있다는 것을 반증한다. 이러한 문제를 해결하기 위하여 필자는 학교폭력의 학생보다 범위가 더 넓고 오랜 기간 소년의 교정과 보호라는 목적을 위해 운영되었던 소년법과 현행 학교폭력예방법을 비교하여 소년법의 몇 가지 제도를 학교폭력예방법에 도입하고자 한다.

Korean society is changing very fast causing disputes between the members and even being developed as social issues. The national assembly enacts laws to resolve these issues. Due to enaction of diverse legislations, there are some laws and articles that are redundant with one another. On the contrary, even though certain laws have similar purposes and characteristics, they lack mutual connection between one another. In this sense, examination of laws with similar purpose can contribute to supplementing other laws and improve the quality of legislation. Among them, education laws should be improved consistently because failure in school education could cause great damage to the country. The biggest issue in school education is that students are not safe from school violence. This is because the school violence prevention law is not functioning properly even though it was enacted to resolve school violence. From this perspective, school violence prevention law should be integrated with another legislation to supplement its shortages. Especially, the reason school violence prevention law seems to be insufficient is because school violence has been one of the biggest social issues until recently. The violence by students is becoming tactful and brutal. School violence prevention law that should be the guide to resolve school violence is not sufficient for the resolution. Therefore, juvenile law and school violence prevention law are compared with each other since juvenile law has wider scope of coverage to correct and protect juveniles and can be considered to be adopted to school violence prevention law.
