대학의 자율성에 관한 연구: 부산교육대학교 강의보조금 회수 처분 사건 판결을 중심으로

자유로운 학문의 추구를 가장 높은 이상으로 삼아야 할 최고 고등교육기관인 대학교의 경우 대학의 자율성 보장이 무엇보다 필요하고, 이를 뒷받침한다는 의미에서 대학의 재정적 자율성 보장 또한 반드시 필요하다. 대학이 전임교수들의 대학원 초과 강의에 대해 초과강의료에 더하여 별도의 강의 보조금을 지급한 것이 합리성과 타당성을 상실하였다고 볼 수 없고, 오히려 대학재정운영의 자율성과 효율성 관점에서 이를 보장해 줄 필요도 있다고 한 이번 판결은 대학의 자치라는 측면에서 지극히 타당한 판결이라고 할 수 있다. 이번 부산교육대학교의 강의보조금 회수 처분 취소 판결을 계기로 교육부의 대학에 대한 감사 권한 행사가 대학의 재정적 자율성을 존중해 주는 방향으로 개선될 수 있기를 기대해 본다.

To support this, it is also necessary to guarantee the financial autonomy of universities basically. The court judges that Busan National University of Education has not lost the rationality and validity of providing extra lecture subsidies in addition to overtime lecture fees for full-time professors overtime lectures on graduate school, and rather it can be guaranteed from the standpoint of autonomy and efficiency of university financial operations. This ruling can be a fair judgment in terms of autonomy of university. It is hoped that this ruling will help the Ministry of Education to exercise its right to audit universities in a way to improve financial autonomy of universities.
