연구의 자율성에 관한 연구: 소위 ‘제자 논문 가로 채기’에 대한 평가를 중심으로

A Study on the Autonomy of Academic Researches: Focusing on the Evaluation of So-Called ‘Interception of Disciple s Thesis’

자유로운 학문의 추구를 가장 높은 이상으로 삼아야 할 최고 고등교육기관인 대학교의 경우 대학의 자율성 보장이 무엇보다 필요하고, 이를 뒷받침하는 연구의 자율성 보장 또한 필요하다. 대학교수가 자신이 지도한 제자의 학위논문을 요약하여 제자와 함께 공동으로 학회지에 투고하거나, 이렇게 투고한 학회지 논문으로 교내 연구비를 지급 받는 것이 반드시 연구 윤리에 반한다거나 징계 사유가 될 수 없다고 한 이번 판결은 학문의 자유라는 측면에서 타당한 판결이라고 할 수 있다. 이번 부산교육대학교의 소위 ‘제자 논문 가로 채기’를 이유로 한 징계 처분 취소 판결을 계기로 교육부의 대학에 대한 감사 권한 행사가 대학에서의 연구의 자율성을 존중해 주는 방향으로 개선될 수 있기를 기대해 본다.

In case of university as the highest educational institute that should take the pursuit of free study as its highest ideal, the guarantee of autonomy of university is the most essential thing, and it would be also necessary to guarantee the autonomy of researches supporting this. The verdict finding that a professor s joint submission of thesis with his/her disciple to a journal by summarizing the graduate thesis by the disciple, or receiving the intramural research funds with the thesis submitted to the journal like this cannot be against the research ethics or a ground for the disciplinary action, might be a quite appropriate ruling in the aspect of academic freedom. With this ruling on the cancellation of disciplinary action for the reason of so-called ‘interception of disciple s thesis’ in Busan National University of Education, the authority to inspect universities by the Ministry of Education should be improved to the direction of respecting the autonomy of research in university.
