지방교육자치권의 현황과 과제: 누리과정 법령 사례를 중심으로

Current Issues and Future Directions on the Decentralization of Education Power

본 연구는 누리과정 정책을 자치분권 측면의 분석 틀을 활용하여 분석하고, 분석결과에 따라 지방교육자치권 강화를 위한 향후 정책 방향과 과제를 제시하였다. 연구 내용과 관련하여 분석한 결과는 다음과 같다. 첫째, 자치권은 헌법에 보장된 지방자치제에 따라 중앙정부의 권한을 지방자치단체에 이양하여 지방자치단체가 관할 구역의 자치사무와 법령에 따라 소관 사무를 처리할 수 있는 제도로서 지방자치권의 행사범위로서 자치사무권, 자치재정권 및 자치입법권이 각각 보장되어 있지만 여전히 법령의 범위 안에서라는 한계를 안고 있다. 둘째, 1991년 이후 지방교육자치제가 재도입된 후 지방교육자치의 주요한 특징인 지방교육의 분권화 및 자율화를 실현하기 위해 노력해 왔지만, 누리과정도입과정에서 드러난 것처럼 중앙정부 권한의 지방이양은 미미한 실정이며, 시ㆍ도교육청은 자치사무권, 자치입법권, 자치재정권 측면에서 자율과 책임을 충분히 수행할 수 없는 제도적 한계를 가지고 있다. 셋째, 지방교육 자치분권 강화를 위하여 우선적으로 중앙과 지방 간 사무구분이 명확하게 이루어질 필요가 있으며, 사무이양 시 관련 자치입법권과 자치재정권이 동시에 포괄적으로 확보ㆍ지원되어야 한다.

This study analyzed Nuri Curriculum policies using a self-governing power framework and drew future policy directions and tasks according to the analysis results. After analyzing the background of introduction, operation status, and financial status of the Nuri program, the relevant policies were analyzed by points of view based on the policy analysis framework of the local autonomy(the autonomous government affairs, legislation, and local finance). The results of the study s analysis are as follows. First, educational decentralization refers to the transfer of power belonging to the authority of the central government(the Ministry of Education) to local governments(Provincial Office of Education) and have them conduct the affairs in their own authority and responsibility, though, there are still limitations within the scope of legislation. Second, local educational decentralization has been implemented to promote local educational autonomy over the past few decades, but it is still insufficient in terms of the actual condition of the autonomous government affairs, legislation, and local finance, which are core elements of local self-governing, the normative expression of the decisive power. Third, in order to overcome the present state of things, there is a necessity that classifies affair belongs between the central government and provincial offices of education and transfers a business authority and a financial authority actively from the central government to provincial offices of education.
