오늘날 학교에서 발생하는 문제점들로부터의 탈피, 그리고 사회와 교육환경의 변화에 따른 적응을 위하여 홈스쿨링이 많이 이루어지고 있다. 하지만 이러한 홈스쿨링은 현행법상으로는 금지되고 있는데 만약 홈스쿨링이 교육적으로 의미가 있는 것이라면 이를 합법화하여 국가가 관리 감독할 필요가 있다. 홈스쿨링을 법률적으로 허용하기 위해서는 우선 홈스쿨링이 현행 헌법상 허용되는 것인가부터 검토가 필요하다. 헌법은 제31조 제2항에서 의무교육을 규정하고 있어서 홈스쿨링이 헌법상 허용되지 않는 것으로 해석 될 여지도 있기 때문이다. 이에 이 연구는 홈스쿨링의 헌법적 쟁점들에 대하여 살펴보고 홈스쿨링이 헌법적으로 허용될 수 있는 것인지 알아보기 위하여 이루어졌다. 홈스쿨링은 부모의 교육권, 학령아동의 교육권, 국가의 교육에 관한 권한 등의 충돌을 야기한다. 그럼에도 현행 헌법상으로도 홈스쿨링은 가능한 것으로 해석되고, 부모와 학령 아동의 기본권과 국가의 권한이 조화롭게 보장될 수 있다.
Today, home schooling is done to escape from problems arising in school public education, and to adapt to changes in society and educational environment. However, these home schooling is prohibited under the current law. If home schooling turns out to be meaningful in educational terms, it needs to be legalized rather than abandoning it as much as it is increasing in society, and to be the administrated and supervised by th state. In order to legally enable home schooling, it is necessary to consider whether home schooling is permitted under the existing constitution. Because the current constitution provides compulsory education under Article 31 paragraph 2, so there is a room for interpreting home schooling as being unacceptable under the Constitution. So this research was done to study the constitutional issue of home schooling and to find out whether home schooling can be tolerated under the current constitution. Parents` home schooling for their children is a fundamental right guaranteed by the Constitution, which is included in the educational rights of parents. However, this conflicts with the authority of national education and the right to carry out compulsory education. The fundamental rights for parents` education are basic natural rights, and basic rights should be guaranteed to the maximum. Therefore, elementary education prescribed by Article 31 (2) of the Constitution and education prescribed by law must be interpreted as an obligation to receive education at the level of curriculum specified by the elementary curriculum and the law, not as an obligation to attended to elementary school. If so, home schooling is acceptable even under the current Constitution. If home schooling is educationally meaningful, then legislation can be enacted that will legitimize home schooling. However, if even children whose recognition and judgment skills are weak is allowed home schooling, which can result in restrictions on children`s rights and may not be desirable for both national and social reasons. Therefore, at least elementary education should be compulsory.
