연구는「평생교육법」연구의 성과를 반추하고, 과제를 전망하고자 하는 목적에서 이루어졌다. 「사회교육법」 제정으로부터「평생교육법」 제정과 전면 개정 과정을 검토하면서, 법률 시행 과정에서 어떤 문제가 제기되었는지를 살펴보았다. 또, 「평생교육법」관련헌법재판 결정례와 각급 법원 판결을 분석하였다. 평생학습 이념을 헌법 개정에 어떻게 반영할 것인가, 교육법 체계에서 평생교육법의 위상을 어떻게 설정할 것인가, 평생교육 거버넌스를 어떻게 구성할 것인가를 평생교육 관계 법령 연구의 쟁점으로 제시하였다. 아울러, 실효성을 제고하기 위하여 법률을 개정하는 과정에서 생활세계의 식민지화라는 법화 현상이 발생하고 있음을 지적하고, 연구의 필요성을 제기하였다.
The purpose of this study is to investigate the current state of research on the lifelong education law and suggest further areas of study. The process of both the enactment and revision of the law was analyzed. A few constitutional judgments and several court judgments were analyzed as well. The further research tasks are: how to revise constitution based on the philosophy of ‘lifelong learning’; how to establish the status of the lifelong education act within the total education law system; how to design governance for lifelong education nationally, as well as locally; how to improve the efficacy of the law while avoiding side-effects of the legalization.
